COMMENTS FROM THE PUBLIC, ACCEPT AND FILE THE REPORT, AND
FINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE
CALIFORNIA ENVIRONMENTAL QUALITY ACT
Public Hearing as required by California Health and Safety Code, Section
116470(b), stating every three years the City of San Clemente must prepare
a report comparing the City’s drinking water quality with Public Health Goals
(PHGs) adopted by California Environmental Protection Agency’s Office of
Environmental Health Hazard Assessment (OEHHA) and/or with maximum
contaminant level goals (MCLGs) adopted by the USEPA.
Staff Recommendation
1. Open the public hearing, receive public comment and close the public
hearing.
2. After conducting the public hearing, adopt Resolution No. 25-128, which
will:
a. Accept and file the City of San Clemente’s 2025 report on public health
goals (PHG’s).
b. Find the project categorically exempt from the California Environmental
Quality Act (CEQA) under Sections 15301, 15308, and 15309 of the
CEQA guidelines (14 CCR § 15301(h), class 1: existing facilities, 15308,
class 8: actions by regulatory agencies for protection of the environment,
and 15309, class 9: inspections). |

Staff Recommendation
Adopt Resolution No. 25-134 which will:

2. Approve the sole source purchase of the Allen Bradley electronic
components and installation materials from OneSource Distributors
based on the fixed price quote, which is provided as attachment 2 of the

Staff Recommendation
Adopt Resolution No. 25-133, which will:
1. Accept the FY 2025 Arterial and Local Street Improvement Program, CIP
Project Nos. 15317 and 15322, from the contractor, ONYX Paving
Company, Inc.
2. Authorize the City Clerk to execute and record the Notice of Completion
for the FY 2025 Arterial and Local Street Improvement Program, CIP
Project Nos. 15317 and 15322.
3. Authorize the City Clerk to release the payment bond 35 days from the
recordation of the Notice of Completion upon verification with the
Engineering Division that no liens have been levied against the contractor,
ONYX Paving Company, Inc.
4. Authorize the City Clerk to release the performance bond for this project
upon receipt of a warranty bond in a form acceptable to the Public Works
Director/City Engineer in the amount of 25% of the total construction cost. |

Staff Recommendation
1. Approve Resolution No. 25-116 which will appropriate $100,000 in Account
No. 001-452-43890, to extend the Pilot Goat-Grazing Project until March 31,
2026, and direct City staff to initiate a Request for Proposals process to
establish a contract for goat grazing services, and determine that the project
is statutorily and categorically exempt from the California Environmental
Quality Act under various provisions.
2. Approve Resolution No. 25-117 which will confirm the City’s commitment to
the 25% match for the Hazard Mitigation Grant Program (HMGP) application
of up to $2,137,500 anticipated to be covered by in-kind contributions of
labor and services, contributions from private property owners such as
Homeowners Associations (HOAs) for the aspects of the project occurring on
privately-owned open space, volunteer labor, potentially other state and
county grant sources, and the City's General Fund.
3. Approve Resolution No. 25-118 which will approve, and authorize the City
Manager to execute, Contract No. C25-42, by and between the City of San
Clemente and E. Stewart and Associates, Inc., providing for the Weed
Abatement Program, consisting of weed abatement and related
defensible-space clearance services, in an amount not to exceed $256,060,
for a five-year term, and appropriate an additional $96,060 to Program 452 Weed Abatement: $45,160 in Account No. 001-452-43470 and $50,900 in
Account No. 001-452-43890. |

Adopt Resolution No 25-115, which will:
1. Authorize staff to develop a staff-managed municipal auction program
managed to promote resident participation and access to purchase surplus
vehicles.
2. Declare the vehicles and equipment listed on Attachment No. 1 - Exhibit A of
the Administrative Report dated August 19, 2025, and on file with the City
Clerk, as surplus.
3. Award a five-year contract to JJ Kane Associates, Inc. for Auction Services in
an amount not to exceed $75,000.
4. Approve, and authorize the City Manager to execute, Contract No. C25-38,
by and between the City of San Clemente and JJ Kane Associates, Inc.,
providing for Auction Services, in an amount not to exceed $75,000, and
authorize the City Manager to exercise additional 1-year renewal options
based on performance.
5. Authorize the disposition of surplus property using a combination of City
staff-managed and third-party auction services pursuant to Policy No. 201-24.
