10. PLANNING COMMISSION VACANCY\nRecommended Action:\nStaff recommends that the City Council:\n1. Direct the City Clerk to publicly announce the two openings on the Planning Commission and\nto approve the application submission timelines specified in the Staff Report;\n2. And designate two Council members to participate in an Ad HOC committee, which will have\nthe specific and temporary duty of selecting commissioners to fill the two (2) vacant positions.

11. FIRST READING AND INTRODUCTION OF AN ORDINANCE OF THE CITY OF BARSTOW\nADDING CHAPTER 5.55 TO TITLE 5 REGARDING TOBACCO RETAILER REGISTRATION\nRecommended Action:\nThat the City Council adopt Ordinance No. XXX-2024 (Attachment 1) requiring registration of\ntobacco retailers and amending the Barstow Municipal Code to add a new chapter 5.55.

5. ACCEPTANCE OF PROJECT 2021-05, GENERATOR REPLACEMENT AT THE FIRE\nDISTRICT'S STATION 363\nRecommended Action:\nStaff Recommends that the City Council take the following actions:\n1. Approve final acceptance of the project named Generator Replacement at Fire District Station\n363\n2. Authorize staff to file the attached Notice of Completion (Attachment A).

6. NORTH BARSTOW ADA INFRASTRUCTURE IMPROVEMENTS\nRecommended Action:\nStaff recommends that the City Council take the following actions:\n1. Approve Final Acceptance of the North Area ADA Infrastructure Improvement Project\n2. Authorize City Staff to file the attached Notice of Completion\n3. Authorize City Staff to re-allocate the remaining funds to CDBG Un-Programmed funds.

7. FINAL ACCEPTANCE OF THE WASTE WATER GRIT CHAMBER REHAB\nRecommended Action:\nStaff recommends the City Council to take the following actions:\n1. Approve the Acceptance of Project WW-24-001, Grit Chamber Rehab\n2. Authorize staff to file a Notice of Completion

8. APPROVAL OF AN AGREEMENT RELATED TO ARPA FUNDS FOR BARSTOW CEMETERY\nRESTROOM PROJECT AND AWARD OF CONTRACT TO TSR CONSTRUCTION\nINCORPORATED\nRecommended Action:\n1. Approve the amended contract between San Bernardino County and the City of Barstow in the\namount not to exceed $446,672.\n2. Authorize the City Manager to sign and execute the appropriate documents.\n3. Authorize city staff to award the contract to the lowest bidder TSR Construction Incorporated.

9. APPROVAL OF UPDATED FY2024/2025 CAPITAL EXPENDITURE BUDGET\nRecommended Action:\nStaff recommends that the City Council take the following actions:\n1. Adopt the updated FY 2023/2024 carry forward budget and appropriate the funding, including\nthe associated revenue and expenditure transfers, as identified in Attachment A.
