Discuss and adopt the attached Resolution No. 5236-2025 of Intention to Disestablish PID\n83-1 (Exhibit A)\n2. Direct staff to move forward with the disestablishment procedures and schedule a public\nhearing for the August 19, 2025, City Council meeting.

FIRST READING AND INTRODUCTION OF AN ORDINANCE ADDING CHAPTER 9.74, AND\nAMENDING SECTIONS 19.14.030, 19.16.020, AND 19.16.030 OF THE BARSTOW\nMUNICIPAL CODE REGARDING SMOKE SHOPS AND TOBACCO STORES – CONTINUED\nFROM JUNE 17, 2025\nRecommended Action:\nThat the City Council adopt Ordinance No. 1032-2025 limiting the proliferation of Smoke Shops\nand Tobacco Stores with the City of Barstow and amending the Barstow Municipal Code to add a\nnew chapter 9.74 and update sections 19.14.030, 19.16.020, and 19.16.030 of the Zoning\nOrdinance of the City of Barstow.

4. PUBLIC HEARING: LIEN PROTEST HEARING FOR DELINQUENT TRASH AND SEWER\nACCOUNTS\nRecommended Action:\nStaff recommends the City Council:\n1. Conduct a protest hearing and subject to testimony received, adopt Resolution No. 52312025 and waive further reading.\n2. Where necessary and relevant, direct staff to resolve any conflicts with protest owners before\nthe final lien and/or property tax assessment list is filed with San Bernardino County.\nAdditionally, authorize staff to remove any properties from the lien and assessment listings\nshould delinquent fees be paid prior to the filing of the final lien list with San Bernardino\nCounty.

PUBLIC HEARING: CONSIDERATION OF DEVELOPMENT AGREEMENT TERMINATION\nFOR COMMERCIAL CANNABIS BUSINESS OPERATOR ZENGROW, INC. – CONTINUED\nFROM JUNE 17, 2025\nRecommended Action:\nThat the City Council adopt the Resolution No. 5232-2025 terminating the development\nagreement with Zengrow (Attachment 4)) and direct staff to take further steps to consummate the\ndevelopment agreement termination. If the development agreement is terminated, the City plans\nto assess its options for how to best use the property.

Adopt Resolution No. 5234-2025 (Attachment B), declaring the City’s intention to reaffirm the\nlevy and collection of annual assessment in Fiscal Year 2025/2026 via the property tax roll in\nconnection with Street Lighting, Flood Control, Landscape & Street Maintenance Benefit\nAssessment Districts No. 1, and waive the full reading.\n3.
