A Resolution finding and determining that the public interest, convenience\nand necessity require the acquisition of certain real property located at\n8833 Cedar Street for public purposes.\nCEQA: The City reviewed the environmental impacts of the proposed Ordinance\npursuant to the California Environmental Quality Act (Public Resources Code\n§§ 21000, et seq. “CEQA”) and the regulations promulgated thereunder (14 Cal.\nCode of Regs. §§ 15000, et seq., the “CEQA Guidelines”). CEQA Guidelines\n§§ 15301 (existing facilities), exempts activities that involve negligible or no\nexpansion of existing or former use. This activity would acquire private property\nfor the purpose of operating, maintaining, and leasing of an existing shelter to\nensure its continued operations. The provisions of the California Environmental\nQuality Act (“CEQA”) are not applicable because the action at issue herein is not\na “project” subject to CEQA under Pub. Res. Code § 21065, as the proposed\nProject will continue existing use of the Property as the New Hope Shelter and\nthus has no potential to cause either a direct physical change in the environment,\nor a reasonably foreseeable indirect physical change in the environment. Even\nassuming, arguendo, that acquisition of the property amounts to a “project” subject\nto CEQA, this activity involves a negligible expansion of the existing use and no\nfurther review is required.\nRecommendation to City Council: 1) Open the public hearing, take testimonial and\ndocumentary evidence, and after considering the evidence, adopt\nResolution No. 24-15 by a minimum two-thirds vote; or 2) Alternatively, discuss\nand take other action related to this item.

(“SFPP”) a\nDelaware Limited Partnership, an oil pipeline franchise within the\nCity of Bellflower.\nCEQA: The proposed ordinance is exempt from additional environmental review\nunder the California Environmental Quality Act (California Public Resources Code\n§§ 21000, et seq., “CEQA”) and CEQA regulations (14 California Code of\nRegulations §§ 15000, et seq.) because the granting of the oil pipeline franchise\nfits within the definition of the Class 1 exemption, “Existing Facilities,” as defined\nin Section 15301(c) of the CEQA regulations. The proposed grant of franchise\ninvolves no or negligible alteration of existing facilities and involves no or negligible\nexpansion of use beyond that existing at the time of the determination that the\nCategorical Exemption applies. Furthermore, the proposed grant of franchise will\nnot adversely impact air quality or any other environmental area, as it will be\nsubject to applicable regulatory requirements.\nRecommendation to City Council: 1) Waive further reading and adopt\nOrdinance No. 1427; or 2) Alternatively, discuss and take other action related to\nthis item.
