A Consideration and possible action to 1) conduct a public hearing to consider\nan appeal from Robert Preece (representing Design UA, Inc.) of the Planning\nCommission’s adoption of Resolution No. PC 24-15; and 2) adopt Resolution\nNo. 24-15 – A Resolution denying an appeal (AP-25-01) and upholding\nPlanning Commission Resolution No. PC 24-15 denying Development\nReview (DR 3-24-15169) and Conditional Use Permit (CU-24-07) for the\nconstruction of a 3,786-square-foot restaurant with a drive-through\ncomponent located at 16211 Bellflower Boulevard.\nCEQA: The City reviewed the environmental impacts of the proposed Project\npursuant to the California Environmental Quality Act (Public Resources Code\n§§ 21000, et seq. “CEQA”) and the regulations promulgated thereunder (14 Cal.\nCode of Regs. §§ 15000, et seq., the “CEQA Guidelines”). CEQA Guideline\n§ 15061(b)(4) exempts projects that are disapproved or rejected. Should the City\nCouncil affirm the Planning Commission’s decision and deny the DR and CUP, no\nfurther environmental review is required. If, however, the City Council opts to\noverturn the Planning Commission’s decision and approve the project, it is still\nexempt pursuant to CEQA Guideline § 15303 (New Construction or Conversion of\nSmall Structures) as the project is less than 10,000 square feet in floor area on a\nsite zones for such use and not involving significant amounts of hazardous\nsubstances where all necessary public services and facilities are available, and\nthe surrounding area is not environmentally sensitive.\nRecommendation to City Council: 1) Open the public hearing; take testimonial and\ndocumentary evidence; and 2) After considering the evidence, adopt Resolution\nNo. 25-15; or 3) Alternatively, discuss and take other action related to this item.

C Consideration and possible action to authorize the City Manager to execute\nAgreement File No. 752.1, in a form approved by the City Attorney, with\nMichael Baker International, to provide an assessment of the Caruthers Park\nRegional Stormwater Capture and Infiltration System.\nCEQA: Pursuant to the California Environmental Quality Act (CEQA) (Public\nResources Code §§ 21000, et seq.) and CEQA Guidelines (California Code of\nRegulations, Title 14, §§ 15000, et seq.), the City conducted an environmental\nassessment.
