2. Approval of the Change Order to the Contract with Doty\nBros. Equipment Company (Bid Schedule No. 1498) –\nBurbank Water and Power Department\n1. Approve the proposed change order to the contract\nwith Doty Bros. Equipment Company (Bid Schedule\nNo. 1498), increasing the contract amount from\n$1,000,000 to $3,500,000 for the third contract year\nfrom April 12, 2023, through April 11, 2024, and\nauthorize the General Manager (GM) of Burbank\nWater and Power, as designee of the City Manager,\nto execute the change order.\n2. Grant the GM of BWP authority to renew Bid\nSchedule No. 1498 for an additional fourth renewal\npursuant to an amendment in form and substance\nsatisfactory to the City Attorney’s Office and to\nexecute future change orders in the current or future\nrenewal contract years up to the budgeted amount\nof the applicable project.

3. Approval of Purchase and Sale Agreement and\nEnvironmental Determination to Facilitate the Purchase\nof Property at 904-906 N. Lake Street – Community\nDevelopment Department\n1. Find that the purchase of the real property located\nat 904-906 N. Lake Street (Property) and continued\nuse of the Property for warehousing and storage\nuses does not constitute the approval of a “project”\nunder the California Environmental Quality Act\n(CEQA) because the activity has no potential for\nresulting in either a direct physical change in the\nenvironment, or a reasonably foreseeable indirect\nphysical change in the environment. Furthermore,\nthe activity is exempt from CEQA under the\ncommon sense exemption as it can be seen with\ncertainty that there is no possibility that this activity\nwill have a significant effect on the environment.\n(Pub. Res. Code § 21065, CEQA Guidelines §§\n15060(c)(2)-(3), 15061(b)(3), 15378). As such, no\nadditional environmental analysis is required at this\ntime.\n2. Approve the City’s purchase of the Property for\n$8,200,000.\n3. Approve the form of the Purchase and Sale\nAgreement and Escrow Instructions (Agreement)\nand authorize staff to continue negotiating the final\nform as long as no changes are made to increase\nthe purchase price or modify the description of\nproperty being purchased, which final Agreement\nshall be approved as to form by the City Attorney?s\nOffice.
