A. Appeal of Variance 23-004 and Conditional Use Permit 23-003\nRecommendation: 1. Conduct a public hearing on Variance 23-004 and\nConditional Use Permit 23-003 to consider an appeal of the\nPlanning’s Commission’s decision on December 6, 2023,\nparticularly denial of Variance 23-004 to delete the parking\nlot shading requirement for a proposed 1,953 square-foot\ncannabis dispensary located at 67455 East Palm Canyon\nDrive within the PCC (Planned Community Commercial)\nZoning District and;\n2. Overturn Planning Commission’s decision and\napprove Variance 23-004;\n3. Remove Condition of Approval No. 3.49 of\nConditional Use Permit 23-003 requiring 50% of the parking\nlot to be shaded; and\n4. Determine this project is categorically exempt from\nCEQA under Section No. 15303 (Class No. 3, New\nConstruction or Conversion of Small Structures) of the State\nCEQA Guidelines
