Therefore, pursuant to State Guidelines Section 15060(c)(3) no environmental review is required. Pursuant to Title 10, Part\n1021.410(a) of the Code of Federal Regulations and the Department of Energy Environmental Guidelines, the activity is Categorical\nExclusions under the National Environmental Policy Act (NEPA).\nRECOMMENDED ACTION:\nAdopt resolutions: (A) Accepting $10,000,000 of “Assistance for the Adoption of the Latest and Zero Building Energy Codes” in grant funds\nfrom the U.S. Department of Energy, authorizing the City Manager or Director of Public Works to serve as the “Authorized Officer” to\nexecute any necessary documents to secure the grant, amending the authorized position count in the Public Works Department to add 1.0\nFTE Conservation Specialist II, and amending the fiscal year 2024-25 budget to appropriate funds for these purposes (4/5 Vote Required);\nand (B) Adopt a resolution to waive the competitive bidding requirements and authorize the City Manager to negotiate and enter into\nagreements with NORESCO and Mile3 Web Development to implement the “Foundation and Framework for Equitable Building\nPerformance Program.”
