Introduction and Adoption by First Reading of Ordinance No. 750 repealing Ordinance No. 689,\nterminating Development Agreement No. 18-017C between the City of Cudahy and Nyce Guys,\nLLC (page 41)\nPresented by the Senior Planner\nRecommendation: City staff recommends that the City Council take the following action(s):\n1. Open the public hearing and receive public comment and testimony;\nand\n2. Make a determination that Nyce Guys, LLC (“Operator”) is not in\ncompliance with the terms and conditions of Development\nAgreement (“DA”) No. 18-017C and find that the Operator is in\ndefault of contractual obligations set forth in the DA; and\n3. Introduce and adopt by first reading Ordinance No. 750 repealing\nOrdinance No. 689 terminating DA No. 18-017C, between the City of\nCudahy and Nyce Guys, LLC; and\n4. Open the public hearing and receive public comment and testimony;\nand\n2. Make a determination that VM Evergreen, LLC (“Operator”) is not in\ncompliance with the terms and conditions of Development\nAgreement (“DA”) No. 18-001C with the City and find that the\nOperator is in default of contractual obligations set forth in the DA;\nand\n3. Introduce and adopt by first reading Ordinance No. 751 repealing\nOrdinance No. 698 terminating DA No. 18-001C, between the City of\nCudahy and VM Evergreen, LLC; and Schedule the second reading of\nOrdinance No. 751 at the next regularly scheduled meeting on August\n20, 2024; and\n4. Make a determination that 420 Club, LLC (“Operator”) is not in\ncompliance with the terms and conditions of Development\nAgreement (“DA”) No. 18-012C and find that the Operator is in\ndefault of contractual obligations set forth in the DA; and\n3. Open the public hearing and receive public comment and testimony;\nand\n2. Make a determination that Staple Room, LLC (“Operator”) is not in\ncompliance with the terms and conditions of Development\nAgreement (“DA”) No. 18-015C with the City and find that the\nOperator is in default of contractual obligations set forth in the DA;\nand\n3. Introduce and adopt by first reading Ordinance No. 755 repealing\nOrdinance No. 700 terminating DA No. 18-015C between the City and\nStaple Room, LLC; and\n4. Schedule the second reading of Ordinance No. 755 at the next\nregularly scheduled meeting on August 20, 2024; and\n5. G. Adoption by First Reading of Ordinance No. 741 Amending Cudahy Municipal Code Section\n10.04.020 (Vehicle Weight Limits) by adding Patata Street to the list of streets where vehicles\nexceeding 6,000 pounds are prohibited. (page 3457)\nPresented by the Community Development Director\nRecommendation: Staff recommends that the City Council take the following actions:\n1. Open the public hearing and receive comments; and\n2. Adopt by first reading Ordinance No. 741 (Attachment A), an\namendment to the Cudahy Municipal Code (“CMC”) Section\n10.04.020 (Vehicle Weight Limits) by adding Patata Street to the list of\nstreets where vehicles exceeding 6,000 pounds are prohibited; and\n3. Schedule a second reading of Ordinance No. 741 at the next regularly\nscheduled City Council meeting on August 20, 2024; and\n4. Find the Project exempt from the California Environmental Quality\nAct (“CEQA”) pursuant to CEQA Guidelines Section 15061(b)(3).

H. Adoption of Resolution No. 24-28 Memorializing a Public Hearing and Levying the Annual\nAssessment to Maintain the City of Cudahy Street Lighting District and Direct Staff to Forward the\nResolution to the Los Angeles County Assessor (page 3475)\nPresented by the Finance Director\nRecommendation: The City Council is requested to:\n1. Open the public hearing and receive comments; and\n2. Adopt Resolution No. 24-28; memorializing a Public Hearing and\nLevying the Annual Assessment to maintain the City of Cudahy Street\nLighting District for Fiscal Year (FY) 2024/25; and\n3. Direct staff to forward Resolution No. 24-28 to the Los Angeles\nCounty Assessor before the August 10, 2024, deadline.

A. Request for Authorization to Execute LS-1 Option E Agreement and all Relevant Forms, with\nSouthern California Edison to Replace High Pressure Sodium Vapor Street Lights with Light-\nEmitting Diode Street Lights District-Wide (page 3525)\nPresented by the Building Official\nRecommendation: Staff recommends that the City Council of the City of Cudahy (the “City”)\ntake the following actions:\n1. Adopt Resolution No. 24-29 (Attachment A) to Execute an LS-1\nOption E authorization with SCE to replace high pressure sodium\nvapor (HPSV) streetlights with light-emitting diode (LED) street\nlights; and\n2. Authorize the City Manager to sign the agreement authorization and\nrelevant form(s).
