10B. Public hearing to consider the introduction of Ordinance No. 2026-10 to adopt Chapter 30.21 "Residential in Commercial Zones Pursuant to State law" to Title 30 Zoning of the Encinitas Municipal Code to implement AB 2011 and SB 6 citywide and amendments to the Downtown Encinitas and North 101 Corridor Specific Plans to reference and incorporate objective design standards. Environmental Considerations: The action being considered by the City Council is exempt from the California Environmental Quality Act (CEQA) because the amended Ordinance is intended to implement Senate Bill 6 and Assembly Bill 2011 and is not considered a "project" under Division 13 (commencing with Section 21000) of the Public Resources Code, as provided in Government Code Section 65852.24(h), Government Code Section 65912.114(r) and Government Code Section 65912.124(r). Additionally, the amendments to the Downtown Encinitas Specific Plan and the North 101 Corridor Specific Plan, which reference and incorporate the objective design standards as an appendix, are exempt pursuant to CEQA Guidelines Section 15061(b)(3). This exemption applies because it can be seen with certainty that the adoption of these amendments will not result in a significant effect on the environment. All projects for which the objective design standards would apply would undergo separate project level specific CEQA review and approval. 8H. Acceptance of the Grandview Staircase Repair Project (CP23A). Environmental Considerations: This project is Categorically Exempt (CE) from the California Environmental Quality Act (CEQA) pursuant to Section 15301 (d) of the CEQA Guidelines. This section exempts rehabilitation of deteriorated or damaged structures to meet current standards of public health and safety. 8I. Approve the Design for the FY 2026-27 Drainage Rehabilitation Project (CD27A) and Lake Drive Storm Drain Lining Project (CD27B) and Authorize Advertisement for Construction. Environmental Considerations: Pursuant to the California Environmental Quality Act (CEQA), an Environmental Initial Study (IS) was conducted for the Lake Drive Storm Drain Project, which determined that the proposed project may have potentially significant environmental effects related to biological resources, geology and soils, cultural resources, and tribal cultural resources. Specific mitigation measures were determined to avoid or mitigate the potential significant environmental impacts to below established levels of significance. A Mitigated Negative Declaration (MND) and Mitigation Monitoring and Reporting Program (MMRP) was prepared and adopted by the Planning Commission (PC Resolution No. 2026-15). A Notice of Determination was filed with the State Clearing House (SCH#2025110169) and County Clerk Office (2026-000567). All mitigation measures applicable to the Lake Drive Storm Drain Lining Project will be implemented. The FY 2026-27 Drainage Rehabilitation Project is Categorically Exempt (CE) from the California Environmental Quality Act (CEQA) pursuant to Section 15302 (c) of the CEQA Guidelines. This section exempts the replacement and reconstruction of existing facilities that will substantially have the same purpose and capacity as the structure being replaced. None of the exceptions in Section 15300.2 of the CEQA Guidelines are applicable to the project.
