Adoption of Ordinance No. 1946 (Second Reading), a 21-2974\nDevelopment Agreement between the City of Fontana and\nChase Partners.\nSecond Reading / Adoption of Ordinance No. 1946, Approving, pursuant to\nan adopted Mitigated Negative Declaration, a Development Agreement No.\n23-001 between the City of Fontana and Chase Partners, which provides a\npublic benefit fee in the amount of $150,896.25.

G. Adoption of Ordinance No. 1947 (Second Reading), a 21-2976\nzoning change from Community Commercial (C-1) to Light\nIndustrial (M-1)\nSecond Reading / Adoption of Ordinance No. 1947, Approving, pursuant to\nan adopted Mitigated Negative Declaration and approved Mitigation\nMonitoring and Reporting Program for the Citrus and Boyle Project, Zoning\nDistrict Map Amendment No. 22-009 to change the zoning designation for\nAPN: 0251-151-10 from Community Commercial (C-1) to Light Industrial\n(M-1) for approximately 0.9 acres located on the north side of Slover Avenue,\neast of Citrus Avenue.

H. Adoption of Ordinance No. 1948 (Second Reading), a 21-2977\nDevelopment Agreement between the City of Fontana and\nChipt Fontana Citrus Avenue, L.P.\nSecond Reading / Adoption of Ordinance No. 1948, Approving, pursuant to\nan adopted Mitigated Negative Declaration, a Development Agreement No.\n23-096 between the City of Fontana and Chipt Fontana Citrus Avenue, L.P.,\nwhich provides a public benefit fee in the amount of $49,722.00.

I. Contractor Substitution Due to Job Abandonment and 21-2888\nBankruptcy from Previously Awarded Construction\nContract for Public Works Concrete Maintenance Project\n(SB-107-PW-23)\nApprove and authorize the City Manager to execute a construction contract\nwith Gentry General Engineering, Inc for the remaining work required to\ncomplete the construction of Public Works Concrete Maintenance Project in\nthe amount of $168,840.00 (Bid No. SB-107-PW-23).

J. Approve an Agreement with the Inland Empire Utilities 21-2971\nAgency, Speedway SBC Development, LLC, and San\nBernardino County for Wastewater Services for Speedway\nSBC Development, LLC\nApprove and authorize the City Manager to execute an agreement with the\nInland Empire Utilities Agency (“IEUA”), Speedway SBC Development, LLC,\nand San Bernardino County (“County”) for wastewater services for Speedway\nSBC Development, LLC.

K. Fontana Community Senior Center Beauty Salon Lease 21-2935\nAgreement\n1. To authorize the Community Services Department to enter into a lease\nagreement with Boss Hair Studios to offer hair styling, nail and retail\nservices at the Fontana Community Senior Center.\n2. Authorize the City Manager or his designee to execute any documents\nnecessary to effectuate said agreement.

L. Acceptance of Parcel Map No. 19712 and Abandonment of 21-2938\na Certain Portion of Right of Way of Coyote Canyon Road\nand Lytle Creek Road\nAccept Parcel Map No. 19712 located northwest of Interstate 15 (I-15) and\nwest of Sierra Avenue, along the south side of Lytle Creek Road, accept as\npublic dedicated streets and easements, and authorize the Mayor and City\nClerk to certify the abandonment of a certain portion of right of way of Coyote\nCanyon Road and Lytle Creek Road.

M. Approve a Bond Reduction for Tract No. 17041 - Lot 2 21-2940\n(In-tract Improvements) located within the Citrus Heights\nNorth Specific Plan (Shady Trails)\nApprove a reduction of the Faithful Performance Bond, Labor and Material\nBond, and the Warranty Bond posted by Taylor Morrison of California, LLC.\nfor Tract 17041 - Lot 2, for the in-tract improvements consisting of street,\nstreet light, storm drain, and sewer, located within the Citrus Heights North\nSpecific Plan (Shady Trails).

N. Fontana Auto Center - Pylon Sign Refurbishment 21-2941\n1. Authorize City Manager to complete upgrades to the Fontana Auto Center\npylon signage in the amount of $127,710.

O. Issuance of Special Tax Bonds for CFD #111 (Monterado) 21-2946\nAdopt Resolution No. 2024-018, of the City Council of the City of Fontana\nauthorizing the issuance of City of Fontana Community Facilities District No.\n111 (Monterado) Special Tax Bonds, Series 2024, in an aggregate principal\namount of not to exceed $8,000,000, authorizing the execution and delivery\nof an Indenture, a Bond Purchase Agreement and a Continuing Disclosure\nAgreement, authorizing the distribution of an Official Statement in connection\ntherewith and authorizing the execution of necessary documents and\ncertificates and related actions.

P. Fontana Expanded Learning Program Services Agreement 21-2949\nApprove the Fontana Expanded Learning Program Services Agreement.

Q. Approve the Sale of Real Property by the Successor 21-2954\nAgency to the City of Fontana\nApprove the Purchase of Real Property Identified as APN 0228-301-51 -\nLocated at Citrus And South Highland Avenues - by The City of Fontana and\nAuthorizing the City Manager To Negotiate and Execute a Purchase and\nSale Agreement with the Successor Agency to the Fontana Redevelopment\nAgency

A. Ordinance No. 2024-1949: An Ordinance of the City Council 21-2842\nof the City of Fontana, California, Pursuant to an Exemption\nfrom the California Environmental Quality Act, Approving a\nDevelopment Agreement with HS Fontana Retail, LLC,\nconcerning a retail cannabis business and Direct Staff to\nFile a Notice of Exemption.\nBased on the information in the staff report and subject to the findings,\nconclusions, and information in the staff report, resolution and presented in\nthe public hearing, staff recommends that the City Council adopt Ordinance\nNo. 2024-1949; and\n1. Find, after review of the whole of the Project, including this Development\nAgreement, that the project is EXEMPT from the California Environmental\nQuality Act (“CEQA”), pursuant to State CEQA Guidelines Section 15301\n(Existing Facilities) and direct staff to file a Notice of Exemption; and\n2. Approve a Development Agreement with HS Fontana Retail, LLC, based\nupon the findings in the staff report and ordinance, pending adoption of\nan Operating Agreement with HS Fontana Retail, LLC.\n3. Approve an Operating Agreement with HS Fontana Retail, LLC, as\nrequired by FMC 33-21.
