Approval of Maintenance Services Agreement for City Wide HVAC\nMaintenance and Repair Services with First Response Air Conditioning &\nHeating, Inc.\nRecommendation\nStaff recommends that the City Council:\n1. Approve the Maintenance Services Agreement for Citywide HVAC\nMaintenance and Repair Services in the not-to-exceed amount of $75,000\nper year for Fiscal Years 2023-24 through 2025-26, subject to extension\nadministratively for two additional one-year periods;\n2. Approve a not-to-exceed 20% contingency per year of the total contract\nvalue in the amount of $15,000 for unforeseen conditions or extra work and\nauthorize the Public Works Director/City Engineer to approve additional\nwork with First Response Air Conditioning & Heating Inc. for a total not-to-\nexceed amount of $90,000 per year, if needed; and,\n3. Authorize the City Manager to execute the agreement and future\namendments to the Maintenance Services Agreement with First Response\nAir Conditioning & Heating Inc., subject to the City Attorney making non-\nsubstantive changes.

Approval of Amendments to Maintenance Services Agreement with Coastal\nBuilding Services, Inc. for Janitorial Services at City Parks and Metrolink\nStation; Commercial Building Management Services, Inc. for Janitorial\nServices at City Facilities; Sage Environmental Group LLC for City Wide\nWeed Abatement Services; and SCA of CA LLC for Citywide Street Sweeping\nServices\nRecommendation\nStaff recommends that the City Council:\n1. Approve Amendments to the subject Maintenance Services Agreements to\nexercise an optional one-year term extension and increase the total annual\nnot-to-exceed contract amount by three percent (3%) for Fiscal Year 2023-\n24;\n2. Approve the addition of a not-to-exceed 20% contingency of the total\ncontract amount equal to $15,776 on Amendment No. 2 with Sage\nCity Council Regular Meeting Agenda Page 3 of 7 June 20, 2023\nEnvironmental Group LLC, as included in the table above, for unforeseen\nconditions or extra work and authorize the Public Works Director/City\nEngineer to approve additional work;\n3. Approve the assignment of all rights and obligations under the Agreement\nwith Jonset Corporation dba Sunset Properties to SCA of CA LLC in\nAmendment No. 1;\n4. Approve the addition of a price escalation clause applicable to the remaining\nfuture option year extension in the Amendments to the Maintenance\nServices Agreements with Commercial Building Management Services, Inc.\nand SCA of CA LLC; and,\n5. Authorize the City Manager to execute the Maintenance Services\nAmendments, and future amendments to the agreements, subject to the\nCity Attorney making non-substantive changes.

Approve the recommended list of projects for Fiscal Year 2023-24 to be\nfunded by SB 1: The Road Repair and Accountability Act of 2017; and,\n2. Adopt Resolution No. 2023-1435, Adopting a List of Projects for Fiscal\nYear 2023-24 Funded by SB 1: The Road Repair and Accountability Act of\n2017.

8. Orange County Transportation Authority OC Go (Measure M2) Eligibility\nPackage Submittal\nRecommendation\nStaff recommends that the City Council:\n1. Adopt Resolution No. 2023-1436, adopting a Seven-Year Capital\nImprovement Program for Fiscal Years 2023-24 through 2029-30 for\ncompliance with the Measure M2 eligibility requirements;\n2. Adopt Resolution No. 2023-1437, concerning the status and update of the\nCirculation Element and Mitigation Fee Program for the City of Laguna\nNiguel;\n3. Adopt Resolution No. 2023-1438, concerning the update of the Local\nSignal Synchronization Plan Update for the City of Laguna Niguel; and,\n4.
