Award the Construction Contract for the Marina Hills Drive (Niguel Road to\nGolden Lantern) Resurfacing Project, Cash Contract No. 22-14 to Onyx\nPaving Company, Inc. in the amount of $2,122,000;\n2. Authorize the Public Works Director/City Engineer to process change\norders in an amount not to exceed 10% of the contract for $212,200, for a\ntotal not-to-exceed amount of $2,334,200 if needed;\n3. Authorize the City Manager to execute the Construction Contract for the\nMarina Hills Drive (Niguel Road to Golden Lantern) Resurfacing Project,\nCash Contract No. 22-14 with Onyx Paving Company, Inc., subject to the\nCity Attorney making non-substantive changes;\n4. Authorize the Public Works Director/City Engineer to execute the Notice of\nCompletion at the conclusion of construction; and,\n5. Transfer $315,000 in American Rescue Plan Act funds from the Residential\nAnnual Resurfacing Program (Zones 3 & 4) to the Marina Hills Drive –\nNiguel Road to Golden Lantern Project.

7. Approval of Plans and Specifications for Marina Hills Park Improvements\nProject, Cash Contract No. 22-15, and Authorization to Advertise the Project\nfor Bids\nRecommendation\nStaff recommends that the City Council:\n1. Approve the plans and specifications for the Marina Hills Park\nImprovements Project, Cash Contract No. 22-15; and,\n2. Resolution to Initiate the Procedures to Exchange an Access Driveway\nEasement Over a Minor Portion of Crown Valley Park for an Easement Over\nAdjacent Private Property (The Village Shopping Center) for Overflow\nParking for Park Users and to Conditionally Approve a Reciprocal Easement\nAgreement, and finding said action exempt from CEQA pursuant to State\nCEQA Guidelines Section 15301 (Existing Facilities)\nRecommendation\nStaff recommends that the City Council:\n1. Adopt Resolution 2023-1450 to initiate the discontinuance of the use of a\nminor portion of Crown Valley Park that currently serves as a landscape\nborder, in exchange for an easement for non-exclusive use of up\nto five parking spaces at 30001 Crown Valley Parkway, Laguna Niguel,\nCalifornia, by users of Crown Valley Park and to call a public hearing on\nDecember 5, 2023, regarding the proposed minor exchange of park land,\nand finding that such action is exempt from CEQA pursuant to State CEQA\nGuidelines Section 15301 (Existing Facilities);\n2. Upon completion of the procedures necessary to discontinue the applicable\nportion of Crown Valley Park, approve a reciprocal easement agreement\nbetween the City of Laguna Niguel and MV/The Village, LLC, regarding the\nproposed minor exchange of park land (“Easement Agreement”);\n3. Direct the City Clerk to cause Resolution 2023-1450 to be published and\ncirculated in accordance with Government Code Section 38445; and\n4.
