Public Hearing
1. Public Hearing to Consider Zoning Code Amendment ZCA 24-1001 and\nZoning Code Amendment ZCA 24-1002 to Address State Mandates\nRecommendation\nStaff recommends that the City Council open the public hearing, take public\ntestimony, close the public testimony, and then take the following actions:\n1. Find that adoption of Zoning Code Amendment ZCA 24-1001 and Zoning\nCode Amendment ZCA 24-1002 are exempt from the California\nEnvironmental Quality Act (“CEQA”) because they are both an\nadministrative activity that will not result in a direct or reasonably\nforeseeable indirect physical change to the environment and thus is not a\n“project” under State CEQA Guidelines Section 15378 (see State CEQA\nGuidelines, Section 15060(c)(2) and (3)). Alternatively, even if adoption of\nZCA 24-1001 and ZCA 24-1002 did qualify as a project under CEQA, find\nthat it is exempt from CEQA pursuant to Section 15061(b)(3), which\nprovides that a project is exempt from CEQA where it can be seen with\ncertainty that there is no possibility that the activity in question may have a\nsignificant effect on the environment. And find that, moreover, Zoning Code\nAmendment ZCA 24-1001 is statutorily exempt from CEQA under Public\nResources Code section 21080.17.\n2. Waive full reading, make any amendments to, and introduce Ordinance No.\n2024-232 (Attachment A) by title:\nORDINANCE NO. 2024-232\nAN ORDINANCE OF THE CITY OF LAGUNA NIGUEL, CALIFORNIA,\nADOPTING ZONING CODE AMENDMENT ZCA 24-1001 AMENDING\nREGULATIONS PERTAINING TO ACCESSORY DWELLING UNITS AND\nJUNIOR ACCESSORY DWELLING UNITS TO CONFORM WITH\nREVISIONS TO STATE LAW; AND DETERMINING THE ACTION TO BE\nEXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT\nUNDER STATE CEQA GUIDELINES SECTIONS 15060(C)(2), 15060(C)(3),\n15061(B)(3), AND PUBLIC RESOURCES CODE SECTION 21080.17.\n3. Waive full reading, make any amendments to, and introduce Ordinance No.\n2024-233 (Attachment C) by title:\nORDINANCE NO. 2024-233\nAN ORDINANCE OF THE CITY OF LAGUNA NIGUEL, CALIFORNIA,\nADOPTING ZONING CODE AMENDMENT (ZCA) 24-1002 AMENDING\nVARIOUS SECTIONS OF THE GATEWAY SPECIFIC PLAN TO ADDRESS\nSEVERAL STATE MANDATES; AND DETERMINING THE ACTION TO BE\nEXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT\nUNDER STATE CEQA GUIDELINES SECTIONS 15060(C)(2), 15060(C)(3),\nAND 15061(B)(3)\n4. Direct that the proposed ordinances, with any changes, be placed on the\nagenda for the January 21, 2025, City Council Meeting and adopt the\nordinances at that meeting.
