1.\nApprove the Community Preferred Alternative for the La Paz Road Mobility\nEnhancements and Permanent Repair Project, Direct Staff to Proceed with\nFinal Engineering Design, and Find the Project Categorically Exempt from\nCEQA\nRecommendation\nStaff recommends the City Council:\n1. Approve the Community Preferred Alternative for the improvements to La\nPaz Road from Aliso Creek Road to Crown Valley Parkway, consisting of\ntwo vehicular travel lanes, Class IV bikeways, pedestrian improvements,\nlandscape improvements, roundabouts at the intersections of La Paz Road\nat Rancho Niguel Road and La Paz Road at Yosemite Road, and earth\nmovement repair;\n2. Direct staff to proceed with final engineering design of Plans, Specifications,\nand Estimates (PS&E) for the project;\n3. Find the project categorically exempt from the California Environmental\nQuality Act (CEQA) under CEQA Guidelines, Section 15301, Class 1\n(Existing Facilities), and Section 15304, Class 4 (Minor Alterations to Land);\nand,\n4. Direct staff to prepare, execute, and file with the County Clerk and State\nClearinghouse a Notice of Exemption documenting this categorically\nexempt finding within five working days of its approval.

7.\nSecond Reading and Adoption of Ordinance No. 2025-236, Prohibiting the\nSale and Distribution of Kratom and Nitrous Oxide Products\nRecommendation\nMayor Gennawey and Mayor Pro Tem Johns recommend that the City Council\nconduct a second reading, by title only, and adopt Ordinance No. 2025-236:\nORDINANCE NO. 2025-236\nAN ORDINANCE OF THE CITY OF LAGUNA NIGUEL, CALIFORNIA,\nAMENDING DIVISION 3 OF TITLE 5 OF THE LAGUNA NIGUEL MUNICIPAL\nCODE, PROHIBITING THE SALE AND DISTRIBUTION OF KRATOM\nPRODUCTS AND NITROUS OXIDE PRODUCTS, AND MAKING A\nDETERMINATION OF EXEMPTION UNDER CEQA IN CONNECTION\nTHEREWITH

8.\nAward of Professional Services Agreement for Defensible Space and\nVegetation Management Study to Dudek\nRecommendation\nStaff recommends that the City Council:\n1. Award the Professional Services Agreement for Defensible Space and\nVegetation Management Study to Dudek in the not-to-exceed amount of\n$72,762;\n2. Approve a not-to-exceed 20% contingency of the total contract in the\namount of $14,552 for unforeseen conditions or extra work and authorize\nthe City Manager to approve additional work for a total not-to-exceed\namount of $87,314, if needed; and,\n3. Authorize the City Manager to execute the Professional Services\nAgreement with Dudek, subject to the City Attorney making non-substantive\nchanges.
