Approve final record plans and specifications reflecting\ncompletion of the “Pavement Management Plan Project\n(Northbound Moulton Parkway between Calle Cortez and Via\nCampo Verde)” as prepared by the project engineer.\nAND\n2. Accept project completion of the contract agreement with\nHardy & Harper, Inc. for the “Pavement Management Plan\nProject (Northbound Moulton Parkway between Calle Cortez\nand Via Campo Verde)”.\nAND\n3. Release contract retention in the amount of $12,178.23\nwithheld per California Government Code 35 days following\nrecordation of the Notice of Completion with the County of\nOrange, provided no Stop Notices are on file with the City\npreventing the release of the contract retention.\nAND\n4. Exonerate project posted bonds 35 days following recordation\nof the Notice of Completion with the County of Orange.

Recognizing the Laguna Woods Civic Support Fund’s success,\nmaturity as an organization, and ability to function independent\nof the City, direct the Mayor to provide written notice of the\nCity’s termination of its formal involvement as contemplated in\nSection 5.5 of the Laguna Woods Civic Support Fund’s Bylaws.\nAND\n3. Approve a contribution of $5,000 to the newly independent\nLaguna Woods Civic Support Fund to support future activities.\nAND\n4. Appoint Councilmember Moore to serve as a liaison to the\nLaguna Woods Civic Support Fund to foster communication\nbetween the City and Laguna Woods Civic Support Fund\nrelated to their shared interest in supporting the City and\nLaguna Woods Branch of OC Public Libraries, from January\n18, 2023 through December 31, 2024

8.2 Cannabis Retail Sales Business Regulations\n(agendized by Councilmember Horne)\nRecommendation:\n1. Direct the City Manager to draft an ordinance for future\nconsideration by the City Council that would – if adopted by\nthe City Council at a future meeting – authorize the operation of\nstorefront retailer (dispensary) businesses engaged in retail\nsales of cannabis and/or cannabis products.\nAND\n2. Direct the City Manager to draft a resolution for future\nconsideration by the City Council that would – if approved by\nLaguna Woods City Council Agenda 01/18/2023 Regular Page 7 of 9\nthe City Council at a future meeting – set the rate of the\ncannabis business tax authorized by Measure T (Ordinance No.\n22-01) for storefront retailer (dispensary) businesses at the\nhigher of the following: (a) 10% of gross receipts received or\ngenerated for each monthly reporting period, or (b) $35 per\nsquare foot of floor area (annual tax rate) prorated monthly to\none-twelfth of the annual tax rate amount.
