RESOLUTION NO. ____________ - AWARD AND APPROVAL OF CONSTRUCTION\nCONTRACT CONTRACTOR: HERZOG LARISON JOINT VENTURE BERTHS 302-305 ON-\nDOCK RAILYARD EXPANSION SPECIFICATION NO. 2817\nTransmittal 1\nTransmittal 2\nTransmittal 3\nTransmittal 4\nSummary: Staff requests approval of an award of a contract (Contract) to Herzog/Larison A\nJoint Venture (HLJV), to construct the Berths 302-305 On-Dock Railyard Expansion project\n(Project). The Project consists of installing five new loading railroad tracks and additional\nimprovements at the Fenix Marine Services Terminal. The lowest responsive and responsible\nbidder is HLJV, located at 600 S. Riverside Road, Saint Joseph, MO 64507. The Contract\namount of $63,612,714.00 plus a 10% contingency, is $69,973,985.00, and the Contract\nduration is 730 calendar days. Certain expenses, up to $37,378,743.00, incurred under the\nproposed Contract are eligible for reimbursement under grant funding provided by the\nMaritime Administration (MARAD) Port Infrastructure Development Program through the\nUnited States Department of Transportation (USDOT) and the Trade Corridor Enhancement\nProgram (TCEP) through the California Department of Transportation (CALTRANS). The City\nof Los Angeles Harbor Department (Harbor Department) will be responsible for\n$32,595,242.00 in expenses, net of grant reimbursements.\nRecommendation: Board resolve to (1) find that the Director of Environmental Management\nhas determined that the proposed action has been previously evaluated pursuant to the\nrequirements of the California Environmental Quality Act (CEQA) under Article II Section 2(i)\nand is administratively exempt from requirements of CEQA under Article II Section 2(f) of the\nLos Angeles City CEQA Guidelines; (2) find that, in accordance with the Los Angeles City\nCharter Section 1022, work under the subject Contract can be performed more feasibly by an\nindependent contractor rather than by City employees; (3) find that the bid from the apparent\nlow bidder, Balfour Beatty, is non-responsive due to Balfour Beatty not meeting the required\nSmall Business Enterprise requirement and having a listed subcontractor, Raymond Youash\nTrucking, without a valid Department of Industrial Relations No. as required in the contract;\n(4) award and approve, Specification No. 2817 for Item Nos. 1 through 44 of the Bid Proposal\nLine Items to HLJV for a total amount of $69,973,985.00 including a 10% contingency, and a\ntotal term of 730 calendar days; (5) authorize the Executive Director to execute and the Board\nSecretary to attest to this Contract for and on behalf of the Board; (6) delegate and authorize\nthe Executive Director to adjust the final bid quantities and accept the construction Contract\nupon its completion in accordance with City Charter Section 655 (g); and (7) adopt Resolution\nNo. ____________.\nPort Police

RESOLUTION NO. ____________ - ORDINANCE AMENDING THE LOS ANGELES\nADMINISTRATIVE CODE TO FORMALLY ESTABLISH A LOS ANGELES HARBOR\nDEPARTMENT PORT POLICE RESERVE CORPS\nTransmittal 1\nSummary: The Port Police Division requests Board of Harbor Commissioners (Board)\napproval of an Ordinance which would amend the Los Angeles Administrative Code (LAAC)\nto formally establish a Los Angeles Harbor Department Port Police Reserve Corps. The\nproposed Port Police Reserve Corps program would be comprised of five reserve officers\nserving on a volunteer basis with Harbor Department-provided uniforms and equipment\nincluding a ballistic vest, badge, duty firearm, taser and handheld radio. The Harbor\nDepartment would be financially responsible for payment of $119,950 in initial expenses\n($23,990 per officer) incurred to furnish the five reserve officers with equipment; $3,250 in\nannual expense reimbursements ($650 per officer) for uniform cleaning and firearms\nmaintenance; as well as up to one uniform replacement per year in the amount of $510 per\nofficer.\nRecommendation: Board resolve to (1) find that the Director of Environmental Management\nhas determined that the proposed action is administratively exempt from the requirements of\nthe California Environmental Quality Act (CEQA) under Article II Section 2(f) of the Los\nAngeles City CEQA Guidelines; (2) approve language of Ordinance amending the Los\nAngeles Administrative Code to formally establish a Los Angeles Harbor Department Port\nPolice Reserve Corps; (3) authorize and direct the Board Secretary to transmit the Ordinance\nadding Article 4, Sections 23.67 through 23.67.6, to Division 23, Chapter 3 of the Los Angeles\nAdministrative Code to the City Council for consideration pursuant to Charter Section 250; (4)\nupon the City Council’s approval of the Ordinance, authorize the Chief of the Port Police to\nimplement the Port Police Reserve Corps in accordance with Los Angeles Administrative\nCode Division 23, Chapter 3, Article 4 after the effective date of said Ordinance for and on\nbehalf of the Board; and (5) adopt Resolution No.________.
