September 16, 2026 Item 7 (7) 26-1247 PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT relative to the preparation of draft ordinances to amend Chapters I and 1A of the Los Angeles Municipal Code (LAMC) to maintain conformance with the City Charter, including Measure PL, which introduces several changes related to planning and land use matters. Recommendation for Council action, pursuant to Motion (Blumenfield - McOsker): 1. REQUEST the City Attorney, in consultation with the Department of City Planning (DCP), to prepare and present a draft ordinance that amends Chapter I and 1A of the LAMC, applicable overlays, and other zoning regulations, and environmental clearance language, as necessary to implement and conform those provisions to the Charter amendments contained in the Charter Ballot Resolution dated June 29, 2026 relating to the DCP (Council File No. 26-1100-S12) contingent upon approval of the applicable Charter amendments by the voters at the November 3, 2026 election. 2. REQUEST the City Attorney, with the assistance of the DCP, to include in the ordinance amendments necessary to create consistent references throughout the LAMC, and applicable zoning regulations to the revised Charter Section 552, and any other code amendments needed as necessary, including the following, if Measure PL is approved by the voters: a. Remove references to the Area Planning Commissions as decision-making or appellate authorities and replace those references with the Neighborhood Appeals Commission. b. Preserve geographic representation corresponding to the seven existing Area Planning Commission areas in establishing the composition and geographic representation of the Neighborhood Appeals Commission. c. Provide that any appeals of decisions made by the City Planning Commission or Neighborhood Appeals Commission be heard by the City Council where procedures for second level appeals are required. 3. REQUEST the City Attorney, with the assistance of the DCP to include the necessary environmental clearance language in the ordinance that is consistent with the proposed amendment to Charter Section 555, wherein a General Plan Amendment is not acted upon within 75 days, the General Plan Amendment shall be deemed approved by operation of law, and that all requirements of the California Environmental Quality Act (CEQA) (Public Resources Code Section 21000, et seq.) shall be complied with and nothing therein is intended to eliminate the right of any interested party to appeal a CEQA determination pursuant to Public Resources Code Section 21151(c) or anything in LAMC Chapter 1A, Section 13B.11.1.F, adopted to implement Section 21151(с). 4. REQUEST the City Attorney, in consultation with the DCP, include language in the ordinance to remove from the LAMC (Chapter I and Chapter 1A) any outdated references to repealed Charter Sections 562, 563, 564, and 565. 5. REQUEST the City Attorney, in consultation with the DCP to include language in the ordinance that expressly provides that its operative provisions are contingent upon voter approval of Measure PL, and that if the measure is not approved by the voters, this Ordinance shall not be made operative. 6. REQUEST the City Attorney, in consultation with the DCP, include language in the ordinance that finds that the ordinance is intended to establish consistency between the City Charter, the LAMC, Chapter I and 1A, and other applicable zoning regulations and overlays, and does not constitute an action subject to the procedures in Charter Section 558, and therefore referral to the City Planning Commission for a report, and recommendation is not required. Accordingly, the ordinance shall proceed directly to the Council for consideration and action, in the event that Measure PL is approved by the voters on November 3, 2026. INSTRUCT the DCP, with the assistance of LADBS, and in consultation with the City Attorney, to prepare and present an Interim Control Ordinance (ICO) to prohibit the issuance of any demolition, building, use of land, grading, and any other applicable permits or certificates of occupancy for large cold storage warehousing and distribution uses within close proximity of residential neighborhoods and sensitive uses, such as but not limited to, parks, schools, day care centers, and libraries, in the Boyle Heights community. 5. INSTRUCT that the ICO include an Urgency Clause, making it effective upon publication, and consistent with California Government Code Section 65858, the ICO shall run for 45 days, with an option to extend by 10 months and 15 days by Council Resolution, and can be further extended by an additional one year, or until the appropriate land use regulatory controls have been prepared by the DCP, adopted by the Council and become effective, whichever occurs first. INSTRUCT LADBS, in coordination with the City Attorney's Office, to report back within the next 7 days on the City’s current citation and fine structure, and provide recommendations for increasing penalties for notices of violations and/or noncompliance on projects that impose a significant impact to the community, as seen in the 1400 S Los Palos St. incident. These recommendations should include a fee and fine structure that ranges from $25,000 to $1,000,000 per fine. 2. INSTRUCT CID, with the assistance of LADBS and the City Attorney's Office, to report with a proposed mechanism to dedicate a specific amount or percentage of any fees and fines collected as a result of non- compliance findings at the building located at 1400 S. Los Palos St., Los Angeles, CA 90023, toward financial support for those directly affected by the Lineage Warehouse fire. 3. INSTRUCT CID to report with recommendations for a financial support program funded by the fees and fines described above, to include, but not be limited to, a guaranteed income component for businesses, residents, and workers directly impacted by the Lineage Warehouse fire, including provisions to prevent such a program from limiting Lineage’s tort liability and/or whether the City could recover the costs of a financial support program from Lineage. 4. INSTRUCT the City Administrative Officer with assistance from LADBS and the City Attorney’s office to report with recommendations for offsetting the City’s cost for responding to the Lineage Warehouse fire located at 1400 South Los Palos Street, Los Angeles, CA 90023. 5. Emergency response intake and coordination protocols, including how storm-related emergency requests are received, prioritized, assigned, and tracked from 311, the Mayor's Office, Council Offices, and other City departments. c. Recommendations and best practices for residents and businesses to prepare for heavy rainfall, flooding, mudslides, and other storm-related hazards. d. Public information on accessing emergency and non- emergency services, including relevant phone numbers, online resources, and sandbag locations. 2. INSTRUCT the Public Works Bureaus, with assistance from the City Administrative Officer (CAO), to periodically prepare post- storm reports following the El Niño or other emergency rainstorm events, including work performed and emergency response activities undertaken, storm-related 311 service requests received and addressed, outstanding service requests and response activities, and damage to the public right-of-way, including identified repair and restoration needs. 3. INSTRUCT the BSS, in consultation with the Los Angeles Fire Department, to identify at least two fire stations and/or any other public locations per Council District to provide sand and sandbags, and report with the identified locations and a public outreach plan. 4. INSTRUCT the Emergency Management Department, in consultation with the Public Works Bureaus, to report on a public notification strategy to inform impacted residents of available resources and services in advance of significant storm events, including opportunities to expand the scale and reach of existing outreach, potential technology improvements, and the staffing and resources necessary for implementation. The revised fees apply primarily to commercially driven activities and are designed to ensure that all eligible administrative and operational costs are fully recovered. Based on historical permit activity, full cost recovery for Building Materials, Overloads, Special Events, Haul Routes and Water Discharge permit, which have together accounted for over 95 percent of Fiscal Year 2025 Investigation and Enforcement Division permit revenue, is projected to increase annual permit revenues from approximately $2.3 million to approximately $5.0 million, or an estimated $2.8 million contribution to the General Fund. Absent adoption of the proposed fee adjustments, General Fund resources would continue to be required to subsidize the BSS's cost of administering these permits. The CAO reports that the proposed new fee structure fully covers the cost of the overall permitting process based on the time and effort required to process the permit. INSTRUCT the Bureau of Sanitation (BOS) and other relevant departments to report to Council on resources required for the following, with funding from the Mitigation Response Fund: a. Expanding odor, vermin, and pest mitigation in surrounding zones. b. Identifying and mitigating any disaster impacts not being addressed by current response efforts. c. Fully restoring public health, welfare, and the local environment. 3. INSTRUCT the Community Investment Department, in coordination with the BOS and other relevant departments, to report to Council on mobilizing Family Resource Centers to address the above disaster and provide direct financial relief to impacted small businesses, with funding from the Mitigation Response Fund.
