DEVELOPER: HIGHLAND FAIRVIEW OPERATING\nCO. (Report of: Public Works)\nRecommendations:\n1. Approve the Cooperative Agreement with the Riverside County Flood\nControl and Water Conservation District (the District), the City of\nMoreno Valley (the City), and Highland Fairview Operating Co. (the\nDeveloper), for the MDP Line F, Stage 4 and Moreno – Line F\nLaterals.\n2. Authorize the City Manager to execute the Cooperative Agreement.\n3. Direct the City Clerk to forward the signed Cooperative Agreement to\nthe District.

J.1. DEVELOPMENT IMPACT FEE NEXUS STUDY AND DEVELOPMENT\nIMPACT FEE SCHEDULE (Report of: Public Works)\nRecommendations: That the City Council:\n1. First Public Hearing:\na) Conduct the first Public Hearing for the proposed adoption of the\nDevelopment Impact Nexus Fee Study Update (Dated April 2, 2024)\n(“2024 DIF Nexus Study”) which incorporates the adoption of the City\nof Moreno Valley’s 2024 Capital Improvement Plan for Fiscal Years\n2023-24 and 2024-25;\nb) After the Public Hearing, adopt Resolution No. 2024-XX adopting\nthe 2024 DIF Nexus Study and the 2024 Capital Improvement\nPlan, and finding the action is exempt from CEQA;\n2. Second Public Hearing:\na) Conduct the second Public Hearing for the proposed adjustment of\nthe City’s Development Impact Fees; and\nb) After the Public Hearing, adopt Resolution No. 2024-XX\nadjusting the City’s Development Impact Fees, and finding the\naction is exempt from CEQA.
