Accept the Bonito Canyon Park Shade Structure, CIP No. 15105, from the\ncontractor, Landscape Structures, Inc.\n2. Authorize the City Clerk to execute and record Notice of Completion for\nthe Bonito Canyon Park Shade Structure.\n3. Authorize the City Clerk to release the payment bond 35 days from the\nrecordation of the Notice of Completion upon verification with the\nEngineering Division that no liens have been levied against the contractor,\nLandscape Structures, Inc.\n4. 11F. NOTICE OF COMPLETION - EL CAMINO REAL CORRIDOR RUNOFF\nTREATMENT PROJECT\nStaff Recommendation\nAdopt Resolution No. 25-161, which will:\n1. Accept the El Camino Real Runoff Treatment Project, CIP Project No.\n26802, from the contractor, G2 Construction, Inc.\n2. Authorize the City Clerk to execute and record the Notice of Completion\nfor the El Camino Real Runoff Treatment Project.\n3. Authorize the City Clerk to release the payment bond 35 days from the\nrecordation of the Notice of Completion upon verification with the\nEngineering Division that no liens have been levied against the contractor,\nG2 Construction, Inc.\n4. Authorize the City Clerk to release the performance bond for this project\nupon receipt of a warranty bond in a form acceptable to the Public Works\nDirector/City Engineer in the amount of 25% of the total construction cost.

11G. CONTRACT AMENDMENT - PEDESTRIAN AUDIBLE WARNING SYSTEM\nREHABILITATION PROJECT, TO EXTEND THE CONTRACT TERM UNTIL\nTHE SUCCESSFUL COMPLETION OF THE PROJECT\nStaff Recommendation\nAdopt Resolution No. 25-162, which will:\n1. Approve an amendment to the Professional Consultant Services\nAgreement with Pacific Railway Enterprises, Inc. for the Pedestrian\nAudible Warning System Rehabilitation Project to extend the contract term\nuntil the successful completion of the project.\n2. Approve, and authorize the City Manager to execute, Amendment No. 1 to\nContract No. C24-58, by and between the City of San Clemente and\nPacific Railway Enterprises, Inc., providing for the Pedestrian Audible\nWarning System Rehabilitation Project, to extend the contract term until\nthe successful completion of the project, in a form substantially similar to\nAttachment 2 of the Administrative Report dated October 21, 2025 and on\nfile with the City Clerk.

11H. CONTRACT AWARD - DIGESTER NO. 2 STRUCTURAL AND MECHANICAL\nREHABILITATION, AND FINDING THE PROJECT CATEGORICALLY\nEXEMPT FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT\nStaff Recommendation\nAdopt Resolution No. 25-163 which will:\n1. Find the Digester No. 2 Structural and Mechanical Rehabilitation, CIP\nProject No. 12204 categorically exempt from the California Environmental\nQuality Act (CEQA) under Class 1 (Existing Facilities, 14 CCR section\n15301) of the State CEQA Guidelines.\n2. Award the Digester No. 2 Structural and Mechanical Rehabilitation to\nVicon Enterprise, Inc.\n3. Approve, and authorize the City Manager to execute, Contract No. C2552, by and between the City of San Clemente and Vicon Enterprise, Inc.,\nproviding for the Digester No. 2 Structural and Mechanical Rehabilitation,\nin an amount not to exceed $715,000, in a form substantially similar to\nContract No. C25-52, Attachment 2 of the Administrative Report dated\nOctober 21, 2025 and on file with the City Clerk.

11I. CONTRACT AWARD - CAMINO MIRA COSTA MEDIAN ISLAND, APPROVING\nTHE MODIFIED PEDESTRIAN REFUGE ISLAND DESIGN, AND FINDING THE\nPROJECT CATEGORICALLY EXEMPT FROM THE CALIFORNIA\nENVIRONMENTAL QUALITY ACT\nStaff Recommendation\nAdopt Resolution No. 25-164, which will:\n1. Find the Camino Mira Costa Median Island, CIP Project No. 15323,\ncategorically exempt from the California Environmental Quality Act\n(CEQA) under Class 1 (Existing Facilities, 14 CCR section 15301) of the\nState CEQA Guidelines.\n2. Approve the modified design as illustrated in Attachment 4 of the\nAdministrative Report, dated October 21, 2025 and on file with the City\nClerk, as follows:\na. Pedestrian refuge island in the painted median on Camino Mira Costa.\nb. Signage and flashing beacons to alert approaching drivers about the\npresence of pedestrian refuge island and crossing pedestrians.\nc. PED XING markings in the vehicular travel lanes leading up to the\nrefuge island.\nd. 30-foot red curb on both sides of Camino Mira Costa in front of Mira\nCosta Park.\n3. Award the Camino Mira Costa Median Island construction contract to\nGentry General Engineering, Inc. as lowest responsible and responsive\nbidder.\n4. Approve, and authorize the City Manager to execute, Contract No. C2553, by and between the City of San Clemente and Gentry General\nEngineering, Inc., providing for the Camino Mira Costa Median Island, in\nan amount not to exceed $74,846, in a form substantially similar to\nAttachment 3 of the Administrative Report dated October 21, 2025 and on\nfile with the City Clerk.

11J.\nCONSIDERATION OF ADOPTING THE 2025 SEWER SYSTEM\nMANAGEMENT PLAN, DESIGNATING A LEGALLY RESPONSIBLE\nOFFICIAL AS REQUIRED BY THE REGIONAL WATER QUALITY CONTROLS\nBOARD’S WASTE DISCHARGE REQUIREMENTS, AUTHORIZING THE CITY\nMANAGER AND THE UTILITIES MANAGER TO APPROVE ANY FURTHER\nMINOR UPDATES TO THE PLAN, AND FINDING THE PROJECT\nCATEGORICALLY EXEMPT FROM THE CALIFORNIA ENVIRONMENTAL\nQUALITY ACT\nStaff Recommendation\nAdopt Resolution No. 25-165, which will:\n1. Find the actions categorically exempt from the California Environmental\nQuality Act (CEQA) under Class 8 of the State CEQA Guidelines, Section\n15308 - Actions By Regulatory Agencies for the Protection of the\nEnvironment.\n2. Appoint the Utilities Manager as the Legally Responsible Official under the\nRegional Water Quality Controls Board’s Waste Discharge Requirements.\n3. Approve and adopt the 2025 Sewer System Management Plan.\n4. Authorize the City Manager and Utilities Manager to approve any future\nminor updates mandated by the State Water Resources Control Board\nregarding the Sanitary Sewer Management Plan, Sanitary Sewer Overflow\nPrevention Plan and Sanitary Sewer Overflow Emergency Response Plan.

11K. CONSIDERATION OF A RESOLUTION APPROVING FINAL PARCEL MAP\n2025-109, 214 WEST MARIPOSA DUPLEX CONDOMINIUM SUBDIVISION\nStaff Recommendation\nAdopt Resolution No. 25-155, which will:\n1. Approve the Final Parcel Map 2025-109 as it conforms to the\nrequirements set forth in the Subdivision Map Act and the previously\napproved Tentative Parcel Map.\n2. Accept on behalf of the City of San Clemente the water rights as\ndedicated.\n3. Authorize and direct the Public Works Director/City Engineer to execute\nthe Final Parcel Map.\n4. Authorize and direct the City Clerk to execute and submit the Final Parcel\nMap for recordation with the County of Orange Recorder’s Office.

11L.\nCONSIDERATION OF A RESOLUTION APPROVING AN EASEMENT FOR\nRIGHT OF WAY, CONSTRUCTION, AND MAINTENANCE FOR THE\nRESERVOIR NO. 5 SITE FROM RANCHO SAN CLEMENTE COMMUNITY\nASSOCIATION, AUTHORIZING THE CITY MANAGER TO NEGOTIATE,\nFINALIZE AND EXECUTE THE EASEMENT, ACCEPTING THE EASEMENT\nRIGHTS AS DEDICATED AND FINDING THE ACTIONS CATEGORICALLY\nEXEMPT UNDER THE CALIFORNIA ENVIRONMENTAL QUALITY ACT\nStaff Recommendation\nAdopt Resolution No. 25-166, which will:\n1. Find the actions categorically exempt from the California Environmental\nQuality Act (CEQA) under Class 1 of the state CEQA Guidelines Section\n15301 (14 CCR Section 15301, Existing Facilities).\n2. Approve, and authorize the City Manager to negotiate, finalize and\nexecute an easement (D-543) for the Reservoir 5 site with Rancho San\nClemente Community Association similar to the Easement Deed shown in\nAttachment 2 of the administrative Report dated October 21, 2025 and on\nfile with the City Clerk, with any revisions necessary and advisable in\nconsultation with the City Attorney.\n3. Authorize the City Manager to negotiate and finalize the exhibits to such\nEasement Deed, including Exhibit A (legal description) and Exhibit B (Plat\nMap) of the Administrative Report dated October 21, 2025 and on file with\nthe City Clerk, to cover the area needed for City purposes as generally\nshown in Attachment Number 3 of the Administrative Report dated\nOctober 21, 2025 and on file with the City Clerk.\n4. Accept the dedication and authorize the City Manager to execute a\ncertificate of acceptance of the easement for the Reservoir 5 site.

8A.\nDE NOVO APPEAL HEARING OF PUBLIC HEARING PROJECT (PHP)\n25-323, HANSON HOTEL, A REQUEST TO CONSTRUCT A 61-ROOM\nBOUTIQUE HOTEL WITH ROOFTOP\nRESTAURANT, CAFÉS,\nSUBTERRANEAN PARKING, AND RELATED IMPROVEMENTS, AND\nFINDING THE PROJECT CATEGORICALLY EXEMPT FROM THE\nCALIFORNIA ENVIRONMENTAL QUALITY ACT\nDe Novo Public Hearing to consider a development request for the Hanson\nHotel, Public Hearing Project (PHP) 25-323, which was approved by the\nPlanning Commission on August 20, 2025, and subsequently appealed to\nthe City Council by a member of the public. The Project includes the\ndevelopment of a three-story, 61 room hotel, with a third-floor rooftop\nrestaurant and bar, two cafes, pool with a bar and restaurant, and a two-level\nsubterranean parking structure with site improvements including walls,\nhardscape, landscaping, pedestrian improvements, improvements in the City\nright-of-way, outdoor seating for the restaurants and cafes, amplified music,\nand full range alcohol service (Type 47 License). The Project is located on a\nvacant lot at 1801 N. El Camino Real, which is within North Beach/North El\nCamino Real Focus Area and Gateway in the Mixed Use 1 (MU1) zoning\ndesignation. The site is also within the Central Business (CB) District,\nArchitectural (A) Overlay, and Coastal Overlay (MU1-A-CB-CZ).\nStaff Recommendation\nContinue the public hearing, to a date uncertain, to consider the appeal of\nPublic Hearing Project (PHP) 25-323, Hanson Hotel, to allow staff the time to\ncomplete the environmental analysis necessary to fully respond to the issues\nraised in the appeal.

Other amendments are of an administrative\nor procedural nature and concern themselves with subjects that are not\ncovered by the Code or are reasonably necessary to safeguard life and\nproperty within the City of San Clemente. Adoption of these codes as\namended will implement the latest codes in the City, and complies with\ncurrent State law and Repeals Ordinance No.1738.\n3. Set a Public Hearing for November 4, 2025, to consider the adoption of\nOrdinance No. 1796, and direct staff to advertise the Public Hearing as\nrequired by State law.
