Item 202: Appeal of the Environmental Determination for the Balboa Drive Slurry Seal and\nRestriping Project.\nThis item will be considered in the afternoon session which is scheduled to begin at\n2:00 p.m.\nTotal Estimated Cost of Proposed Action and Funding Source:\nThe appeal fee of $1,000 is paid by the applicant for staff time and other administrative\ncosts.\nCouncil District(s) Affected: 3.\nProposed Actions:\nAppeal of the Environmental Exemption determination pursuant to California\nEnvironmental Quality Act (CEQA) State Guidelines, Sections 15301 (Existing Facilities)\nand 15304 (Minor Alterations to Land) for the Balboa Drive slurry seal and re-striping\nproject. The project will re-purpose the existing public right-of-way on Balboa Drive\nbetween Upas Street and 8th Avenue in the City of San Diego to implement bicycle and\nparking improvements. The proposed improvements include slurry seal and re-striping\nwhich involves mill and pave along portions of the roadway and asphalt slurry overlay for\nthe majority of the roadway and re-striping the southbound vehicular travel lanes to\naccommodate angle parking along the west side of the roadway and to designate this\nroadway as a Class III bike facility in the southbound direction. Parallel parking on the\neast side of Balboa Drive is retained.\nThe project was determined to be categorically exempt from CEQA on February 22, 2023.\nThe scope of the subject hearing only includes the environmental determination and not\nthe project.\nAccording to San Diego Municipal Code Section 112.0520(e) Power to Act on Appeal,\nthe City Council shall consider the appeal and may:\n(1) By a majority vote, deny the appeal and approve the environmental determination that\nthe project is exempt from CEQA pursuant to Guidelines Sections 15301 (Existing\nFacilities) and 15304 (Minor Alterations to Land); or\n(2) By a majority vote, grant the appeal and set aside the environmental determination in\naccordance with San Diego Municipal Code Section 112.0520(f);\nDirect the City Attorney to prepare the appropriate resolution according to Section 40 of\nthe City Charter;\nIf the City Council grants the appeal, a lower-decision maker's decision to approve the\nproject shall be held in abeyance. The City Council shall retain jurisdiction to act on the\nrevised environmental determination and associated project at a subsequent public\nhearing.\nThis item is not subject to the Mayor's veto.
