B. APPEAL (APPEAL NO. 23-002) OF PLANNING CASE NO. PPD21-008\nPRECISE PLAN OF DESIGN (330 WEST LAS TUNAS DRIVE)\nAPPELLANT: LOZEAU DRURY, LLP / SUPPORTERS ALLIANCE FOR\nENVIRONMENTAL RESPONSIBILITY (SAFER)\nThis appeal application (APPEAL No. 23-002) is to appeal the Design Review\nCommission’s decision to approve a Precise Plan of Design (PPD21-008) for a\nproposed medical office building located at 330 West Las Tunas Drive. The\nproposed project would demolish the existing one-story medical office\nbuilding and construct a new five-story, 74,490 square foot medical office\nbuilding on a 63,779 square foot (approximately 1.46 acres) lot. The subject\nproperty is zoned MF (Medical Facilities) under the Mission District Specific\nPlan and has a General Plan Land Use Designation of Medical Facilities. There\nis no fiscal impact associated with the consideration of an appeal.\nCalifornia Environmental Quality Act (CEQA) Determination: Not a Project as\ndefined in Section 15378 of the State CEQA Guidelines.\nRecommended Action:\nStaff recommends that the City Council:\nADOPT a Resolution DENYING the appeal and upholding the APPROVAL of\nResolution No. 23-04 for Planning Case No. PPD21-008 for a Precise Plan of\nDesign at 330 West Las Tunas Drive, subject to the recommended conditions\nof approval.\nAlternative Options for Consideration\n➢ Option 1 – APPROVE the appeal, make the findings, and direct staff to\nreturn with a Resolution for the DENIAL of Planning Case No. PPD 21-008\nat the next regularly scheduled City Council meeting on September 5,\n2023.\nOption 1 would mean that the project would not be constructed.\n➢ Option 2 – DENY the appeal, MODIFY in whole or in part, the action of\nthe Design Review Commission, make the findings, and direct staff to\nreturn with an amended Resolution for the APPROVAL of the Planning\nCase No. PPD 21-008 at the next regularly scheduled Council meeting on\nSeptember 5, 2023.\nCity Council Regular Meeting Agenda – August 15, 2023 7\nOption 2 would mean approving the project with modifications in\nresponse to the City Council direction.
