1. PUBLIC HEARING TO CONSIDER ADOPTION OF ORDINANCE NO. O-23-\n1406 (FIRST READING) ADDING MUNICIPAL CODE SECTION 23.06.16\nTO IMPLEMENT STATE LAW REGARDING PARKING REQUIREMENTS\nWITHIN A HALF-MILE OF PUBLIC TRANSIT\nRecommendation: Staff recommends the City Council conduct a public hearing and\nintroduce for first reading Ordinance No. O-23-1406. If the City Council agrees, an\nappropriate motion would be:\n“I move to waive full reading and introduce by title only Ordinance No. O-23-1406, an\nOrdinance of the San Marino City Council adding San Marino Municipal Code Section\n23.06.16 to implement Assembly Bill 2097 by eliminating minimum parking\nrequirements on a residential, commercial, or other development project if the project\nis located within one-half mile of public transit.”

O-23-\n1407 (FIRST READING) AMENDING MUNICIPAL CODE SECTIONS\n23.02.14 AND 23.15.04.1 TO ALLOW MINISTERIAL APPROVAL WHEN\nRECONFIGURING SPACE WITHIN AN EXISTING DWELLING UNIT IN\nTHE SINGLE-FAMILY (R-1) ZONE TO CREATE NO MORE THAN TWO\nADDITIONAL BEDROOMS\nRecommendation: Staff recommends the Council conduct a public hearing and\nintroduce for first reading Ordinance No. O-23-1407. If the City Council agrees, an\nappropriate motion would be:\n“I move to waive full reading and introduce by title only Ordinance No. O-23- 1407, an\nOrdinance of the San Marino City Council amending San Marino Municipal Code\nSections 23.02.14 and 23.15.04.01 to implement Assembly Bill 916 by allowing\nministerial approval when reconfiguring space within an existing residential dwelling\nunit in the single-family (R-1) zone to create no more than two additional bedrooms.”\nNEW BUSINESS

3. AMERICAN RESCUE PLAN ACT APPROPRIATIONS\nRecommendation: Staff recommends the Council approve the budget appropriations\nas noted in the staff report to appropriate funds from the American Rescue Plan Fund\nfor costs that the City has already incurred or for projects that are on-going. If the\nCity Council concurs with staff’s recommendation, an appropriate motion would be:\n“I move to approve the budget appropriations as noted in the staff report to\nAGENDA – SEPTEMBER 29, 2023 PAGE 3 of 4\nappropriate funds from the American Rescue Plan Fund for costs that the City has\nalready incurred or for projects that are on-going.”\nCONSENT CALENDAR

APPROVAL OF OFFICE OF TRAFFIC SAFETY (OTS) GRANT AGREEMENT\nFOR SELECTIVE TRAFFIC ENFORCEMENT\nRecommendation: Staff recommends City Council approve the agreements for OTS\nGrant Funding and authorize the Chief of Police and the Finance Director to enter into\nthe agreements with the Office of Traffic Safety in an amount not to exceed $83,040\nin the fiscal year ending June 30, 2024 and add $83,040 of estimated revenues and\nappropriate $83,040 of expenditures as noted in the Staff Report from the OTS Grant\nFund. If the City Council concurs with staff’s recommendation, an appropriate motion\nwould be:\n“I move to approve and authorize the Chief of Police and the Finance Director to enter\ninto the agreements with the Office of Traffic Safety in an amount not to exceed\n$83,040 in the fiscal year ending June 30, 2024, and add $83,040 of estimated\nrevenues and appropriate $83,040 of expenditures as noted in the Staff Report from\nthe OTS Grant Fund.”\nWRITTEN COMMUNICATIONS OR PUBLIC WRITINGS DISTRIBUTION\nThis is an opportunity to announce any written communications pertaining to the City\nreceived by members of the City Council.
