O-\n23-1407 (FIRST READING) AMENDING MUNICIPAL CODE SECTIONS\n23.02.14 AND 23.15.04.1 TO ALLOW MINISTERIAL APPROVAL WHEN\nRECONFIGURING SPACE WITHIN AN EXISTING DWELLING UNIT IN\nTHE SINGLE-FAMILY (R-1) ZONE TO CREATE NO MORE THAN TWO\nADDITIONAL BEDROOMS\nRecommendation: Staff recommends the Council adopt Ordinance No. O-23-1407. If\nthe City Council concurs with staff’s recommendation an appropriate motion would be:\n“I move to waive full reading and introduce by title only Ordinance No. O-23- 1407, an\nOrdinance of the San Marino City Council amending San Marino Municipal Code\nSections 23.02.14 and 23.15.04.1 to implement Assembly Bill 916 by allowing\nministerial approval when reconfiguring space within an existing residential dwelling\nunit in the single-family (R-1) zone to create no more than two additional bedrooms.”\nNEW BUSINESS

APPROVAL OF PURCHASE OF BACKHOE FOR PARKS AND PUBLIC\nWORKS DEPARTMENT FROM JOHN DEERE AND APPROPRIATION OF\n$1,317.35 FROM THE CAPITAL EQUIPMENT FUND RESERVES FOR THE\nPURCHASE\nAGENDA – OCTOBER 11, 2023 PAGE 5 of 6\nRecommendation: Staff recommends the City Council approve the purchase of one\nbackhoe from John Deere in the amount of $71,317.35, and authorize the\nappropriation of $1,317.35 from the Capital Equipment Fund reserves into Account #\n591-48-4613-0000 (Capitalized Equipment).\n“I move to approve the purchase of one backhoe from John Deere in the amount of\n$71,317.35, and authorize the appropriation of $1,317.35 from the Capital Equipment\nFund reserves into Account # 591-48-4613-0000 (Capitalized Equipment).”

11. ADOPTION OF ORDINANCE NO. O-23-1406 (SECOND READING)\nADDING MUNICIPAL CODE SECTION 23.06.16 TO IMPLEMENT STATE\nLAW REGARDING PARKING REQUIREMENTS WITHIN A HALF-MILE\nOF PUBLIC TRANSIT\nRecommendation: Staff recommends the Council adopt Ordinance No. O-23-1405. If\nthe City Council concurs with staff’s recommendation an appropriate motion would\nbe:\n“I move to adopt Ordinance No. O-23- 1406, an Ordinance of the San Marino City\nCouncil adding San Marino Municipal Code Section 23.06.16 to implement Assembly\nBill 2097 by eliminating minimum parking requirements on a residential, commercial,\nor other development project if the project is located within one-half mile of public\ntransit.”

2. RECEIVE AND FILE FINANCIAL REPORT FOR FOURTH QUARTER\n(APRIL 2023 THROUGH JUNE 2023)\nRecommendation: Staff recommends that Council receive and file this report. APPROVAL OF FY 2022-23 BUDGET CARRYOVERS AND FY 2023-24\nRE-BUDGETS AND FINAL FY 2022-23 BUDGET ADJUSTMENTS\nRecommendation: Staff recommends that the City Council approve the requested FY\n2022-23 carryovers, updates to the FY 2023-24 re-budgets, and the budget\namendments to the funds and accounts as noted on the attachments. If the City\nCouncil concurs with staff’s recommendation, an appropriate motion would be:\n“I move to approve the requested FY 2022-23 carryovers, updates to the FY 2023-24\nre-budgets, and the budget amendments to the funds and accounts as noted on the\nattachments in the Staff Report.”

CONSIDERATION OF 4TH AMENDMENT TO ATHENS CONTRACT TO\nALLOW FOR NEGOTIATIONS OF A NEW OR AMENDED CONTRACT TO\nCONFORM TO SB 1383; APPROVE AMENDMENT TO CONTRACT WITH\nECONOMICS FOR WASTE FRANCHISE NEGOTIATION CONSULTING\nSERVICES\nRecommendation: Staff recommends that the City Council approve the 4th\nAmendment to the Agreement with Athens and authorize the City Manager to execute\nan amendment to the contract with Economics to increase the maximum expenditure\namount from $30,000 to $210,000 to accommodate the necessary negotiations. If the\nCity Council concurs with staff’s recommendation, an appropriate motion would be:\n“I move to approve the 4th Amendment to Agreement with Athens, authorize the City\nManager to execute an amendment to the contract with Economics to increase the not\nto exceed amount to $210,000, and authorize an additional appropriation of $125,000\ninto Account #101-40-4104-0000 from the General Fund Reserves as part of the FY\n2023-24 budget.”\nCONSENT CALENDAR

COMMITMENT OF DONATIONS FUND YEAR-END BALANCE RESERVES\nRecommendation: Staff recommends that the City Council approve the accompanying\nresolution to commit the balance as of June 30, 2023 as noted in the attachments. If\nthe City Council concurs with staff’s recommendation, an appropriate motion would\nbe:\n“I move to adopt Resolution No. R-23-26 to commit the balance of $245,604 in the\nDonations Fund as of June 30, 2023.”

AUTHORIZATION OF MEMORANDUM OF AGREEMENT AND\nAPPROPRIATION OF ADDITIONAL BUDGET FOR CONTINUED\nPARTICIPATION IN COYOTE MANAGEMENT PLAN AND INCREASING\nTHE ANNUAL CONTRIBUTION FROM $10,000 TO $10,600\nRecommendation: Staff recommends the Council authorize the City Manager to\nexecute the Second Amendment to the Memorandum of Understanding with the San\nGabriel Valley Council of Governments for participation in the Coyote Management\nImplementation Plan.\nIf the City Council concurs with staff’s recommendation, an appropriate motion would\nbe:\n“I move to authorize the City Manager to execute the Second Amendment to the\nMemorandum of Understanding with the San Gabriel Valley Council of Governments\nfor participation in the Coyote Management Implementation Plan, extending the term\nthrough June 30, 2025 increasing the annual contribution from $10,000 to $10,600,\nand appropriate an additional $600 to account #101-09-4150-0000 for the increase\nfor contracted services.”
