Ratifying the Declaration of Emergency, Approval of Emergency Seal\nBeach Boulevard Waterline Repair and Dispensing with Public Bidding\nRequirements, and Notice of Completion, and Authorization to Approve\nPayment for the Seal Beach Boulevard Waterline Repair, and Approving\nand Authorizing Amendment No. 1 to Professional Maintenance\nAgreement with Valverde Construction, Inc. for On-Call Emergency and\nUnexpected Task Utility Maintenance and Repair Services - That the City\nCouncil adopt Resolution 7465 1. Declaring the Seal Beach\nBoulevard Waterline Repair, CIP EM2402, was necessary for the immediate\npreservation of life, health and property of the City, and therefore ratifying the\ndeclaration by the Public Works Director that the Seal Beach Boulevard.\nWaterline Repair, CIP EM2402, was of urgent necessity for the immediate\npreservation of life, health and property; and, 2. That the City Council adopt\nResolution 7465: 1.. Declaring that the Seal Beach Boulevard Waterline\nRepair, CIP EM2402, was necessary for the immediate preservation of life,\nhealth and property of the City, and therefore ratifying the declaration by the\nPublic Works Director that the Seal Beach Boulevard Waterline Repair, CIP\nEM2402, was of urgent necessity for the immediate preservation of life, health\nand property; and, 2. Authorizing the City Manager to execute a purchase\norder with Valverde Construction, Inc. for the emergency Seal Beach\nBoulevard Waterline Repair, CIP EM2402, in the amount of $256,456.15\nunder an existing on-call agreement with Valverde Construction, Inc. without\nadvertising for bids; and, 3. Accepting the emergency work to the City’s public\nwater system, CIP EM2402, by Valverde Construction, Inc. in the amount of\n$256,456.15; and, 4. Directing the City Clerk to file a “Notice of Completion”\nwith the Orange County Clerk-Recorder within 15 days of the date of approval\nof the resolution and to release retention 35 days after the recordation of the\nNotice of Completion contingent upon no claims being filed on the Project;\nand, 5. Approving Budget Amendment BA #24-05-02 in the amount of\n$260,000.00; and, 6. Approving Amendment No. 1 to the Professional\nMaintenance Agreement with Valverde Construction, Inc. to increase their\ncompensation by $450,000 for additional on-call emergency and unexpected\ntask utility maintenance and repair services for a revised not-to-exceed total\ncontract amount of $750,000 for the original three-year term; and, 7.\nAuthorizing the City Manager to execute Amendment No. 1.
