7.b. CONSIDERATION AND APPROVAL OF RESOLUTION 24-244,\nENTERING INTO A GRANT AGREEMENT WITH THE U.S.\nDEPARTMENT OF HOUSING AND URBAN DEVELOPMENT (HUD)\nFOR THE MERCED AVENUE GREENWAY PROJECT (PHASE II)\nThe Merced Avenue Greenway is currently under construction to enhance\nthe City's ability to clean and capture stormwater, reduce greenhouse gas\nemissions, and mitigate the urban heat island effect. It will also provide\nsafe active transit connections to local parks, schools, and river access.\nThe northern end of the project (Phase II, from Rush St. to Fern St.) is\ncurrently in the design phase and is expected to go out to bid for\nconstruction in July 2025.\nRECOMMENDED ACTION: Staff recommends City Council:\nAdopt Resolution No. 24-244, entering into the 2023 U.S. HUD\nCommunity Project Funding Program Agreement ($3,000,000); and\nAuthorize the City Manager or designee to negotiate and execute the\nAgreement.

CONSIDERATION OF APPROVAL OF RESOLUTION NO. 24-245\nAPPROVING BLANKET AUTHORITY TO FILE APPLICATIONS FOR\nMEASURE A FUNDING AND THE MEASURE A ANNUAL\nALLOCATION GRANT AGREEMENT WITH THE LOS ANGELES\nCOUNTY REGIONAL PARK AND OPEN SPACE DISTRICT\nIn November 2016, Los Angeles County voters approved Measure A, the\nSafe, Clean Neighborhood Parks, Open Space, Beaches, Rivers\nProtection, and Water Conservation Measure. Measure A funds are\nallocated annually to eligible public agencies, including the City of South El\nMonte, to support projects that enhance open spaces, recreational\nfacilities, and environmental conservation. The City’s 2024-2025 portion of\nthe annual special tax on property is estimated to be $97,552.36.\nRECOMMENDED ACTION: Staff recommends City Council:\nAdopt Resolution No. 24-245 to approve Blanket Authority to File\nApplications for Measure A Funding and the Measure A Annual Allocation\nGrant Agreement with the Los Angeles County Regional Park and Open\nSpace District (RPOSD) to receive Measure A Program funding; and\nAuthorize the City Manager or designee to negotiate and execute the\nagreement.

9.a. CONSIDERATION OF RESOLUTION NO. 24-246, RECITING THE FACT\nOF THE GENERAL MUNICIPAL ELECTION HELD ON TUESDAY,\nNOVEMBER 5, 2024 AND DECLARING THE RESULTS OF THAT\nELECTION AND SUCH OTHER MATTERS AS PROVIDED BY LAW\nThe City’s General Municipal Election was held on November 5, 2024. The\nvotes in the election have been tabulated and canvassed by the Los\nAngeles County Registrar-Recorder/County Clerk. The canvass has\ndetermined that that Gloria Olmos has been re-elected as Mayor, Hector\nDelgado has been re-elected to the City Council, Larry Rodriguez has\nbeen elected to the City Council and Measure SEM has been adopted by\nthe voters. The City Council must now take the final steps to formally\ndeclare the results of the election.\nRECOMMENDED ACTION: Staff Recommends City Council:\n1. Adopt Resolution No. 24-246, A Resolution of the South El Monte City\nCouncil reciting the Fact of the General Municipal Election held on\nTuesday November 5, 2024 and declaring the results of that election\nand such other matters as provided by law.

9.b. CONSIDERATION AND ADOPTION OF ORDINANCE NO. 1275, AN\nORDINANCE OF THE CITY COUNCIL OF THE CITY OF SOUTH EL\nMONTE, ADDING CHAPTER 3.05 TO TITLE 3 OF THE MUNICIPAL\nCODE TO IMPOSE A TRANSACTIONS AND USE TAX TO BE\nADMINISTERED BY THE CALIFORNIA DEPARTMENT OF TAX AND\nFEE ADMINISTRATION\nAt the November 5, 2024 General Municipal Election, the voters adopted\nMeasure SEM, which imposes a 0.25% transaction and use tax. Pursuant\nto state law, in order for this tax to become effective, the City Council must\nitself adopt the ordinance that imposes the tax.\nRECOMMENDED ACTION: Staff Recommends City Council:\n1. Find that the adoption of the ordinance is not a "project" subject to the\nrequirements of the California Environmental Quality Act (CEQA)\n(Public Resources Code Section §§21000 et seq.) and CEQA\nGuideline 15378(b)(4); and\n2. CONSIDERATION OF RESOLUTION NO. 24-247, AUTHORIZING CITY\nMANAGER TO EXECUTE AGREEMENTS WITH THE CALIFORNIA\nDEPARTMENT OF TAX & FEE ADMINISTRATION (CDTFA) FOR\nIMPLEMENTATION OF A LOCAL TRANSACTIONS AND USE TAX\n(MEASURE SEM); CONSIDERATION OF RESOLUTION NO. 24-248\nAUTHORIZING THE EXAMINATION OF TRANSACTIONS & USE TAX\nRECORDS; AND AUTHORIZING THE CITY MANAGER TO EXECUTE &\nFILE ADDITIONAL AGREEMENTS, LETTERS AND FORMS WITH THE\nCDTFA AND OTHER APPROPRIATE STATE AGENCIES AS\nREQUIRED FOR IMPLEMENTATION OF THE LOCAL TRANSACTIONS\n& USE TAX (MEASURE SEM) AND TO TAKE SUCH OTHER ACTIONS\nNECESSARY TO IMPLEMENT THE LOCAL TRANSACTIONS & USE\nTAX (MEASURE SEM)\nMeasure SEM, the City’s 0.25% transactions and use tax measure, was\nadopted by the voters at the November 5, 2024 General Municipal\nElection. The new tax will be administered for the City by the California\nDepartment of Tax and Fee Administration. This item recommends that\nthe City Council take the necessary actions to allow the Department of Tax\nand Fee Administration to administer the tax.\nRECOMMENDED ACTION: Staff recommends City Council:\n1. Adopt Resolution No. 24-247, authorizing the City Manager to execute\nagreements with the California Department of Tax and Fee\nAdministration (CDTFA) for the implementation of a local transaction\nand use tax (Measure SEM);\n2. Adopt Resolution No. 24-248, authorizing City representatives and\nsales tax consultant to examine sales, transactions and use tax\nrecords pursuant to Revenue and Taxation Code Section 7056; and\n3. Authorize City Manager to complete, execute, file additional\nagreements, letters, and forms with the CDTFA and other appropriate\nstate agencies as required for the implementation of the City’s local\ntransactions and use tax, and to take such other actions as may be\nnecessary to implement the City’s local transactions and use tax.
