10. Contract with Tripepi Smith.\nRECOMMENDATION: That the City Council approve the proposed\namendment with Tripepi Smith.

11. Approval of 2023-24 OC Animal Care Notice of Intent.\nRECOMMENDATION: It is recommended that the City Council:\n1. Approve and authorize the City Manager to sign the attached Animal Care\nNotice of Intent for the provision of animal care and shelter services for FY\n2023-24 in the amount of $30,225 consistent with the Agreement for Provision\nof Animal Care Services as executed in April 2016; and\n2. The City Manager be directed to include the amount specified in the Notice of\nIntent in the proposed FY 2023-24 City of Villa Park budget.

12. Approval of Amendment to Agreement with Gruber & Associates for\nFinancial Audit Services to Cover FY 2022-23 Through FY 2023-24.\nRECOMMENDATION: That the City Council approve the proposed\nAmendment to the Agreement of May 25, 2021 with Gruber & Associates for audit\nservices, to cover FY 2022-23 through FY 2023-24 and authorize the City Manager\nto execute the Amendment for the City.

13. NV5, Inc. – Engineering Contract Amendment.\nRECOMMENDATION: That the City Council approve the Fifth Amendment to\nthe NV5, Inc. contract for Engineering Services. Under the terms of the\namendment, the contract hourly rates will increase effective May 1, 2023 and\nremain flat at that rate until the contract expires on June 30, 2024. Billings to the\nCity will no longer include a flat charge, but rather actual hours worked. The scope\nof work of the City Engineer and Assistant City Engineer will remain consistent with\nthe existing contract agreement.

14. Third Amendment to Employment Contract with City Manager.\nRECOMMENDATION: That the City Council approve and authorize the Mayor\nto execute the Third Amendment to Employment Contract between the City of Villa\nPark and City Manager Steve Franks.\nCITY MANAGER REPORT

6. Agreement with District Attorney for Prosecution Services.\nRECOMMENDATION: That the City Council approve the attached draft\nagreement and authorize the City Manager to sign and execute the agreement on\nbehalf of the City of Villa Park.\nNEW BUSINESS

7. Inspection / Construction Management Services Contract – FY 2022/2023\nAnnual Street Rehabilitation Project.\nRECOMMENDATION: That the City Council authorize the Mayor to execute a\nstandard professional services agreement with Infrastructure Engineers in the\namount of $81,727.00 for Inspection / Construction Management services for the\nFY 2022/2023 Annual Street Rehabilitation Project.

8. Award of Construction Contract for FY 2022/2023 Annual Street\nRehabilitation Project.\nRECOMMENDATION: That the City Council authorize the Mayor to execute a\ncontract with ONYX PAVING COMPANY, INC., in the amount of $1,818,000.00\nfor FY 2022/2023 annual street rehabilitation project.
