Open the Public Hearing;\n2. Hear the Staff Report;\n3. Solicit input on this Item;\n4. City Council Discussion;\n5. Close the Public Hearing; and\n6. Adopt Resolution No. 23-36 and declare the following property as a Public\nNuisance: 20153-20159 Paseo Del Prado, Walnut, CA 91789 (APN: 8722-038-\n017)

3. Tentative Tract Map (TTM) 84043 – Site Plan and Architectural Review\n(SPC/AR) 2022-116 – Development Agreement (DA)\nRecommendation: That the City Council:\n1. Open the Public Hearing;\n2. Hear the Staff Report;\n3. Receive testimony from the Applicant and any other member(s) of the Public\nregarding the Project;\n4. Discuss amongst Council Members;\n5. Close the Public Hearing; and\n6. Approve the following:\na) Resolution No. 23-37: Approving Tentative Tract Map (TTM) 84043 and\nSite Plan and Architectural Review (SPC/AR) 2022-016, subject to the\nattached Condition(s) of Approval (COA) in Exhibit A.\nb) Introduce by title only and waive further reading of Ordinance No. 23-04,\n“An Ordinance of the City Council of the City of Walnut, California,\nApproving a Development Agreement (DA) for a Residential Project\nLocated on Valley Boulevard (APN(s): 8722-015-009 and 8722-015-\n032).”

4. Resolution No. 23-38 - A Resolution of the City of Walnut Allowing Certain\nClaims and Demands in the Amount of $1,283,301.66 Demand No. 166669\nthrough No. 166753, Both Inclusive Fiscal Year 2022-23\nRecommendation: That the City Council adopt Resolution No. 23-38.

5. Resolution No. 23-39 - A Resolution of the City of Walnut Allowing Certain\nClaims and Demands in the Amount of $45,159.29 Demand No. 166684\nthrough No. 166777, Both Inclusive Fiscal Year 2023-24\nRecommendation: That the City Council adopt Resolution No. 23-39.

6. Resolution No. 23-40 – Confirmation Staff has the Authority to Make Non-\nSubstantive Updates to the Housing Element 2021-2029\nRecommendation: That the City Council adopt Resolution No. 23-40,\nconfirming that Staff has the authority to make non-substantive updates to the\nHousing Element 2021-2029, necessary to address revisions requested by the\nCalifornia Housing and Community Development Department (HCD)

7. Approval of Second Amendment to Facilities Joint Use Agreement between\nthe City of Walnut and Walnut Valley Unified School District\nRecommendation: That the City Council:\n1. Approve the Second Amendment to the Joint Use Agreement between the\nCity of Walnut and Walnut Valley Unified School District (WVUSD); and\n2. Authorize the City Manager to sign the Second Amendment on behalf of the\nCity in substantially the form attached and in such final form as approved by\nthe City Attorney.
