10. AWARD OF AGREEMENT TO MERCHANTS LANDSCAPE SERVICES, INC., FOR\nVILLAGE CENTER DR. RESTORATION PROJECT LMAD ZONE L-2B AND FIND THE\nLAKEVIEW AVE PKWY PLANTING RESTORATION PROJECT EXEMPT FROM CEQA,\nCLASS 1, PURSUANT TO CEQA GUIDELINES, SEC. 15301\nRecommendation:\nIt is recommended that the City Council: 1.) Approve the Award of a Contract Services\nAgreement to Merchants Landscape Services, Inc., in the amount of $112,775.52 for the\nVillage Center Drive Restoration Project (Zone L-2B); and 2.) Authorize the City Manager to\napprove additional expenditures up to $16,916.33 (15% of the agreement value) in contract\ncontingencies for potential additional services and unanticipated work that may arise, for a\ntotal potential agreement amount not-to-exceed $129,691.85; and 3.) Find that the Village\nCenter Drive Restoration Project is categorically exempt from the California Environmental\nQuality Act (CEQA), Class 1, pursuant to CEQA Guidelines, Section 15301; and 4.) Authorize\nthe City Manager to sign and execute the contract services agreement and potential future\namendments to the agreement within the designated contingency amount, on behalf of the\nCity Council.

Adopt proposed Resolution No. 2023-5836,\nauthorizing the annexation of Tract No. 17341 (Cielo Vista Development) into the Landscape\nMaintenance Assessment District (LMAD) and initiating proceedings to levy a proposed new or\nincreased assessment for the Annexation Territory of Tract 17341, known as the Cielo Vista\nDevelopment within the Arterial Lighting Zone, Arterial Landscaping Zone A-3, Traffic Signal\nZone TS-2, and Local Landscaping Zone L-2K within the Yorba Linda Street Lighting and\nLMAD, commencing Fiscal Year 2022/2023; and 2.) Adopt proposed Resolution No. 2023-\n5837, approving the Annexation Engineer’s Report regarding the proposed new or increased\nassessment for the Annexation Territory of Tract 17341, known as the Cielo Vista\nDevelopment within the Arterial Lighting Zone, Arterial Landscaping Zone A-3, Traffic Signal\nZone TS-2, and Local Landscaping Zone L-2K within the Yorba Linda Street Lighting and\nLMAD for Fiscal Year 2022/2023; and 3.) Adopt proposed Resolution No. 2023-5838,\ndeclaring its intention to ballot property owners for a proposed new or increased assessment\nwithin the Annexation Territory of Tract 17341, known as the Cielo Vista Development within\nthe Arterial Lighting Zone, Arterial Landscaping Zone A-3, Traffic Signal Zone TS-2, and Local\nLandscaping Zone L-2K of the Yorba Linda Street Lighting and LMAD commencing with Fiscal\nYear 2022/2023, setting a time and place for a Public Hearing, and authorizing staff to proceed\nwith the balloting procedures.
