1.4 CONSIDERATION OF NOTICE OF INTENT FOR VACATION OF A PORTION OF LAKEVIEW\nDRIVE AND SPRUCE ROAD RIGHT-OF-WAY AND SETTING A PUBLIC HEARING FOR SUCH\nVACATION\nCity Council will consider a formal resolution of intent to vacate a portion of Lakeview Drive and Spruce\nRoad, and set a public hearing date on the matter. The City Council will also consider a formal resolution\ndeclaring the vacation of right-of-way exempt from the Surplus Land Act. The proposed vacation of right-\nof-way (VRW 2022-145) would abandon an approximately 1,000 square foot section of Lakeview Drive and\nSpruce Road. Private improvements supporting the former Cowboy Express Steakhouse, addressed at 40433\nLakeview Drive have been constructed in this portion of the right-of-way, including parking spaces, and a\nretaining wall. On February 1, 2023, the Planning Commission determined that the request is consistent with\nthe General Plan.\nEnvironmental Determination: Under Section 15061(b)(3) of the CEQA Guidelines, this is exempt under\nthe “common sense exemption” and, therefore, no environmental review is required.
