7.1 AN AMENDMENT TO TITLE 9\n“DEVELOPMENT CODE” OF THE TOWN OF\nAPPLE VALLEY MUNICIPAL CODE\nMODIFYING SECTION 9.29.050 “CHURCHES\nIN RESIDENTIAL DISTRICTS” AND SECTION\n9.35.030 “PERMITTED USES” AS IT\nRELATES TO GENERAL REQUIREMENTS,\nSEPARATION DISTANCE REDUCTION\nAND EXPANDING ON LOCATIONS WHERE RELIGIOUS\nINSTITUTIONS CAN BE PLACED WITH APPROVAL OF A\nCONDITIONAL USE PERMIT; FINDING THE ADOPTION OF THE\nORDINANCE EXEMPT FROM CEQA PURSUANT TO SECTION\n15061(B)(3) OF THE CEQA GUIDELINES.\nA. Determine that, Pursuant to Section 21080.17 of the State\nGuidelines to Implement the California Environmental Quality Act\n(CEQA), it has been determined that the project is not subject to\nthe California Environmental Quality Act (CEQA) pursuant to\nSection 15061(b)(3) of the State Guidelines to Implement CEQA,\nwhich states that the activity is covered by the general rule that\nCEQA applies only to projects that have the potential for causing\na significant effect on the environment. Where it can be seen\nwith certainty that there is no possibility that the activity in\nquestion, the proposed Code Amendment, may have a\nsignificant effect on the environment, the activity is not subject to\nCEQA.\nB. Find the facts presented within the staff report support the\nrequired Findings for approval of the proposed Development\nCode Amendment and adopt the Findings.\nC. Move to waive the reading of Ordinance No. 565 in its entirety\nand read by title only.\nD. Introduce Ordinance No. 565 approving Development Code\nAmendment No. 2022-005; and\nE. Direct staff to file a Notice of Exemption with the San Bernardino\nCounty Clerk of the Board.
