37. As-Needed Septic Tank Maintenance Services Master Agreements\nRecommendation: Approve and authorize the Director of Beaches and Harbors\nto award and execute As-Needed Septic Tank Maintenance Services Master\nAgreements (MAs), to provide as-needed septic tank maintenance services at\nCounty-owned or operated beaches (2, 3 and 4), for an initial term of three\nyears, with four one-year renewal options, effective upon execution, at an\nannual aggregate amount not to exceed $1,850,000 or a maximum amount of\n$14,245,000 for all executed MAs over the potential total seven-year term, which\nis inclusive of any potential increase of 10% annually for any unforeseen\nincrease in services; find that the proposed actions are not subject to the\nCalifornia Environmental Quality Act; and authorize the Director to take the\nfollowing actions: (Department of Beaches and Harbors) APPROVE\nAuthorize and execute the renewal options if, in the opinion of the\nDirector, the contractors have effectively performed the services during\nthe previous contract period and the services are still needed and\nrequired;\nIncrease the maximum amount payable under all work orders issued on\nthe MAs up to 10% in any year of the MAs, including any extension\noption, for any additional, unforeseen, or increased services within the\nscope of the MAs, subject to the availability of funds in the Department of\nBeaches and Harbors’ (DBH’s) budget, and increase the annual\naggregate amount to the extent that funding is available from or held by\napproved funding sources;\nExtend the MA term, or any optional MA year, to grant up to 12\none-month extensions for the completion of any work order approved\nbefore the expiration of the MA term or optional MA year, subject to the\nMAs terms and conditions and the availability of funds in DBH’s budget;\nand\nAward and execute MAs to add additional contractors as they become\nqualified throughout the term of the MAs, execute and amend individual\nwork orders to incorporate changes as necessary, execute amendments\nshould a contracting entity merge, be acquired or change its entity, add\nor delete services and categories to the MA as they become necessary,\nand suspend or terminate agreements if, in the opinion of the Director, it\nis in the best interest of the County.
