38. Lower Busch Tank Improvement Project in the City of Malibu\nConstruction Contract\nRecommendation: Acting as the Governing Body of the County Waterworks\nDistrict No. 29, Malibu, certify that the Addendum to the previously adopted\nNegative Declaration (ND) for the Lower Busch Tank Improvement Project\n(Project) in the City of Malibu (3), has been completed in compliance with the\nCalifornia Environmental Quality Act and reflects the independent judgement\nand analysis of the County Waterworks District No. 29, Malibu, as the lead\nagency; find that the Board has reviewed and considered the information\ncontained in the Addendum with the ND prior to approving the Addendum for\nthe Project; approve the revised Project and authorize the Director of Public\nWorks to adopt the plans and specifications and advertise for bids at an\nestimated construction amount between $2,900,000 and $4,300,000 for the\nProject; find pursuant to State Public Contract Code, Section 3400 (c) (2), that\nit is necessary to specify designated items by specific brand name in order to\nmatch other products in use on a particular public improvement, either\ncompleted or in the course of completion; and authorize the Director of Public\nWorks to take the following actions: (Department of Public Works) ADOPT\n4-VOTES\nAdvertise for bids when ready to advertise this Project;\nDetermine whether the bid of the apparent responsible contractor with\nthe lowest apparent responsive bid is, in fact, responsive and, if not\nresponsive, determine which apparent responsible contractor submitted\nthe lowest responsive bid;\nAward and execute a construction contract for the Project with the\nresponsible contractor with the lowest responsive bid within or less than\nthe estimated cost range or that exceeds the estimated cost range by no\nmore than 15%, if additional funds have been identified; and\nExtend the date and time for the receipt of bids, allow substitution of\nsubcontractors and relief of bidders, approve and execute change orders\nwithin the same monetary limits delegated to the Director, accept the\nProject upon its final completion, and make required findings and release\nretention money withheld.
