11. Introduction of an Ordinance to Accept California Coastal Commission\n(CCC) Modifications to the Senate Bill 9 Implementation Ordinance No. 996\nAdopted by the City Council on June 19, 2023, to Amend the Del Mar\nMunicipal Code and Local Coastal Program for Consistency with the April\n9, 2025, Coastal Commission Conditional Certification Decision Relating to\nTwo-Unit and Urban Lot Split Development in Single Dwelling Unit\nResidential Zones\nRecommended Action: 1) Confirm staff’s determination that this action is exempt\nfrom review under the California Environmental Quality Act (CEQA) pursuant to\nCEQA Guidelines Section 15378 and Government Code Sections 65852.21(j)\nand 66411.7(n) because the adoption of an ordinance to implement SB 9 is not\nconsidered a project under Division 13 of the Public Resources Code; and 2)\nIntroduce an Ordinance (Attachment A) to accept changes required by the CCC\nas a condition of final certification of the Local Coastal Program Amendment\n(LCPA), which amends the California Senate Bill 9 (SB 9) Implementation\nOrdinance No. 996 (Attachment B) previously adopted by the City Council on June\n19, 2023, that added new Del Mar Municipal Code (DMMC) Chapters 23.07,\n24.66, and 30.93 and amended DMMC Chapters 30.10, 30.11, 30.12, 30.13,\n30.14, 30.15, and 30.75. The proposed Ordinance would further amend DMMC\nChapters 23.07, 24.66, 30.13, 30.15, and 30.93 for consistency with the April 9,\n2025, CCC conditional certification decision.\nReference: Clerk’s File No. 401-4, 401-9
