11A. SECOND EXTENSION OF EXPIRED COMMERCIAL CANNABIS CULTIVATION\nPERMITS\nAt the April 23, 2024 City Council meeting, the City Council conducted the second reading\nof Ordinance No. 1142, extending expired commercial cannabis cultivation permits in\nexchange for certain fees. Ordinance No. 1142 became effective on May 23, 2024. At the\nMarch 25, 2025 City Council meeting, the City Council granted a second extension\nrequest contingent upon the payment of certain fees and the execution of a First\nAmendment to Cultivation Permit Extension Agreement. The City Council directed staff\nto return with a status update at the June 10, 2025 Council meeting.\nRECOMMENDED ACTION:\n1. City Council find that these actions are not subject to California Environmental Quality\nAct (“CEQA”) pursuant to Sections 15378(b)(5) (Organizational or administrative\nactivities of governments that will not result in direct or indirect physical changes in\nthe environment) and even if they were considered a project, they would still be\nexempt from CEQA under State CEQA Guidelines Sections 15301, 15060(B)(3), and\n15061(B)(3); and\n2. Affirm that the extension period for Stanton Fresh Farms has terminated and become\nnull and void based on a violation of the terms and conditions of the permit extension\nand affirm that Stanton Fresh Farms no longer possesses a valid cultivation permit;\nand\n3. Affirm that the second extension has been granted for Culture Stanton Store based\non their payment of the “One-Time Catch-Up Payment” and their execution of the First\nAmendment to Cultivation Permit Extension Agreement, both of which were submitted\nby the deadline of May 29, 2025.\nStanton City Council Agenda\nJune 10, 2025
