9.I. Right of Way Use Agreement With the Gateway Cities Council of Governments for the Gateway\nCities Regional Fiber Optic Network\n— Recommendation: Find that the project, including the Right-of-Way Use Agreement, is\nstatutorily exempt from CEQA pursuant to Public Resources Code section 21080.51 and all\nnecessary conditions have been or will be satisfied by the Gateway Cities Council of\nGovernments, which is the lead agency;\n— Approve the Right-Of-Way Use Agreement Between the City and the Gateway Cities Council\nof Governments for the Installation, Maintenance, and Operation of the Gateway Cities\nRegional Fiber Optic Network on the City’s Rights-Of-Way; And\n— Authorize the City Manager, or Designee, To Administer the Agreement, Including Approving\nFinalized Plans and Any Other Actions in Connection With the Agreement.
