13.a\nGREENWICH VILLAGE NORTH UNDERGROUND UTILITIES ASSESSMENT\nDISTRICT—ADOPT RESOLUTION TO AWARD CONSTRUCTION CONTRACT,\nAPPROVE AMENDMENT TO AGREEMENT WITH NV5, INC., ADOPT\nRESOLUTIONS TO ISSUE BONDS AND ENROLL ASSESSMENTS - 25-PW-046\nCEQA: The Project is exempt under the California Environmental Quality Act\n(“CEQA”) pursuant to CEQA Guidelines section 15302, class 2 (d) (Replacement\nand Reconstruction). The proposed work consists of conversion of overhead electric\nutility distribution system facilities to underground including connection to existing\noverhead electric utility distribution lines where surface is restored to the condition\nexisting prior to the undergrounding.\n(Public Works Director Joe SanClemente)\nRecommended Action:\nStaff recommends City Council:\n1.\nAdopt a Resolution awarding a Construction Contract to CEM Construction\nCorporation for the CIP 114 Greenwich Village North – Underground\nUtilities Assessment District in the Amount of $2,307,500, Authorizing\nContract Change Orders up to $461,500, Approving Project Design and\nPlans Pursuant to Government Code Section 830.6, and Establishing a\nProject Payment Account” (Attachment 1) to approve the construction\ncontract (Attachment 2);\n2.\nAuthorize the Director of Public Works to file a Notice of Completion\nfollowing final completion of the contract;\n3.\nApprove the Third Amendment to an agreement with NV5, Inc. to provide\nprofessional services for construction management and inspection services\nduring construction which increases the contract amount by $100,000,\nresulting in a total amended not-to-exceed contract amount of $600,000,\nand extends the term of agreement to July 12, 2027 (Attachment 3);\n4.\nAdopt a Resolution authorizing the issuance of Limited Obligation\nImprovement Bonds, approving and directing the execution of a Paying\nAgent Agreement and a Placement Agent Agreement, authorizing sale of\nbonds, and other related documents and actions with respect thereto to\nissue district bonds up to $4,031,600 (Attachment 4), appointing the City\nFinance Manager as paying agent, and authorize the execution of the\nPaying Agent Agreement (Attachment 5), and appointing Hilltop Securities,\nInc. as Placement Agent and authorize the execution of the Placement\nAgent Agreement (Attachment 6);\n5.\nAdopt a Resolution directing the County of Los Angeles Auditor-Controller\nto place the direct assessments for the Greenwich Village North\nUnderground Utilities Assessment District on the County Tax Roll”\n(Attachment 7); and\n6.\nAuthorize the Mayor to execute the proposed contracts and the City Clerk to\nattest, subject to approval by the City Attorney.
