B. Introduction and Adoption by First Reading of Ordinance No. 759 Repealing Ordinance No. 697,\nTerminating Development Agreement No. 18-011C between the City of Cudahy and Aqua Tergere,\nLLC (page 187)\nPresented by the Senior Planner\nRecommendation: The City Council is requested to:\n1. Open the public hearing and receive public comment and testimony;\nand\n2. Make a determination that Aqua Tergere, LLC (“Operator”) is not in\ncompliance with the terms and conditions of Development\nAgreement (“DA”) No. 18-011C with the City of Cudahy (“City”) and\nfind the Operator is in default of contractual obligations set forth in\nthe DA; and\n3. Introduce and adopt by first reading Ordinance No. 759 (Attachment\nA) repealing Ordinance No. 697 terminating DA No. 18-011C between\nthe City and Aqua Tergere, LLC; and\n4. Schedule the second reading of Ordinance No. 759 at the next\nregularly scheduled meeting on April 1, 2025; and\n5. Determine that these actions are exempt from the California\nEnvironmental Quality Act (“CEQA”) pursuant to CEQA Guidelines\nSection 15321 (Enforcement Actions by Regulatory Agencies).
