17. Implementing Governance Reform: Seating the Governance Reform Task\nForce\nRecommendation as submitted by Supervisor Mitchell: Create the Governance\nReform Task Force (Task Force), as set forth in Measure G, and by the\ndeadline therein, to be supported by the Executive Officer of the Board as\nfollows:\nThe Task Force shall be comprised of a total of 15 members at all times,\nincluding two members who shall be selected by each Supervisor and\nappointed by the Board, with a total of 10 members; one of the two\nmembers selected by each Supervisor must be a labor representative\nfrom the County workforce, provided however that no two members shall\nbe a member, employee, officer, or director of the same labor\norganization; and the initial 10 Supervisor-selected members shall be\nappointed no later than March 31, 2025; the remaining five at-large\nmembers shall be selected by a four-fifths majority vote of the\nSupervisor-selected members and appointed by the Board, provided that\nthe 10 Supervisor-selected members shall apply the criteria and conduct\nthe application process set forth below for the selection of the remaining\nat-large members, with such revisions as may be adopted by a four-fifths\nvote of the Supervisor-selected members; and the Task Force collectively\nreflects the diversity of the County to the utmost extent possible; and\nconsistent with the Board’s intention for the Task Force to operate\nindependently, a member may only be removed from the Task Force for\ncause and by the Task Force’s action;\nMembers shall reside or work in the County and reflect the diversity of\nthe County; have demonstrated qualifications and experience in\ncommunity outreach/engagement with marginalized and\nsocioeconomically disadvantaged populations; have demonstrated\nknowledge and expertise in matters relevant to governance reform,\nincluding backgrounds in public administration, policy development,\nacademia, and/or organizational leadership; and have no conflict of\ninterest, or the appearance thereof, with the work and objectives of the\nTask Force;\nThe Task Force’s jurisdiction shall be to develop recommendations to the\nBoard for implementation of Measure G, which shall include the structure\nand responsibilities of the County Executive, Director of Budget and\nManagement, County Legislative Analyst, Ethics Commission, and Ethics\nCompliance Officer, as well as the Office of Ethics Compliance and the\nCharter Review Commission; options for establishing each of the above\npositions and bodies, including identification of funding sources to cover\nall costs associated with the establishment and ongoing operation of the\nsame, only existing County funding sources may be utilized, and cannot\nresult in any additional costs to, or taxes imposed on taxpayers, thus\nfunding must be found within existing resources, any cost savings relied\nupon in any option must be clearly identified, including the amount and\nsource; and changes to the direction and oversight of municipal services\nfor the unincorporated areas, in particular the respective roles of both the\nCounty Executive and the Supervisor representing a particular\nunincorporated area, with any recommended changes, should include\nspecific analysis and justification for how such changes would improve\nthe quality and responsiveness of services and representation of the\nunincorporated areas;\nWhile the Task Force should strive for consensus in all decisions, the\nfollowing require the approval by a majority of Task Force members that\nincludes the affirmative votes of at least two members selected by each\nof the four Supervisors, for a total of eight, including adoption of, or\nrevisions to, the rules and procedures of the Task Force, removal of a\nmember of the Task Force, and adoption of any Task Force\nrecommendation for submission to the Board;\nIn conducting the robust and inclusive community and stakeholder\noutreach and input required by Section 11.74 of Measure G, the Task\nForce shall hold its meetings throughout the County, including in each\nSupervisorial District, with an option for virtual participation; substantively\nengage with community organizations and stakeholders from each\nSupervisorial District; engage and seek feedback from all organizations\nand individuals who provided public comment (in any form) in connection\nwith the Board meetings at which Measure G (or the original motion) was\nconsidered; make all efforts to host meetings at locations that are\naccessible to persons with disabilities and accessible to affordable public\ntransportation; ensure language access to the general public, including\nproviding professional interpretation services, translated written materials,\nand clear mechanisms for requesting accommodations; provide drafts of\nall recommendations to the general public at least 10 days prior to each\nmeeting; and adopt a recommendation only after a public meeting (with\npublic comment) has been held for such recommendation, and after its\nfinal text has been public for at least 30 days;\nInstruct the Executive Officer of the Board to report back to the Board in writing\nwithin 45 days with options for implementation plans to operationalize and\nfacilitate the work of the Task Force, the options must identify staffing and total\ncosts (both one-time and ongoing), as well as any changes, reductions or\nimpacts to current Executive Office operations or functions;\nInstruct the Executive Officer of the Board, in coordination with County\nCounsel, to report back to the Board in writing in 45 days with a recommended\napplication process, including minimum qualifications consistent with this\nmotion, from which the five at-large members of the Task Force will be selected,\nthe recommendations shall set forth an open and public application process for\nindividuals interested in serving as Task Force members, this pool of applicants\nshall be a resource to the Supervisor-selected members in determining\nindividuals for appointment, all individuals appointed as an at-large member\nmust have applied through this public process and met the established minimum\nqualifications, the application process should be designed and conducted with\nthe intention of attracting applicants that satisfy the established minimum\nqualifications and reflect the diversity of the County population, including,\nrace/ethnicity, gender, LGBTQ+ identity, age, system impacted (formerly\nincarcerated, houseless, foster youth, etc.), immigration status, income levels,\nresidence in unincorporated areas of the County, education levels, disabilities,\nreligion, renter-homeowner parity, and geographical diversity; and the initial\napplication window should open as soon as practical after the process and\nqualifications are approved by the Board, and close no later than April 15,\n2025, to allow the Supervisor-selected members of the Task Force to select the\nfive at-large members before the deadline set forth in Measure G;\nInstruct County Counsel, in collaboration with the Executive Officer of the\nBoard, to report back to the Board in writing within 45 days with a draft Board\nresolution, consistent with the Board’s intention to provide a framework in which\nthe Task Force will be otherwise free to govern itself, including establishing\nprocedures and requirements to minimize conflicts of interest and ensure the\nindependence of the Task Force; delegating authorities essential to the Task\nForce’s function; setting forth minimum fundamental standards for public notice\nand participation, language access, culturally responsive and proficient\noutreach, submission of final recommendations to the Board, and compliance\nwith applicable law; and requiring the Task Force to respond to reasonable\nrequests from the Board for updates on its work; and\nConsistent with Section 10.20 of Measure G, which reserves to the Board the\npower to “establish rules of organization and procedure" in furtherance of "the\nconduct of its functions,” the Task Force’s jurisdiction shall not include internal\nBoard procedures, such as: days of the week on which motions are filed, the\nprocess by which motions and pieces of legislation are considered before they\nare agendized at a regularly scheduled Board meeting, Board agenda\nmanagement, and other items pertaining to the procedural rules of the Board.\n(24-5539)
