52. Burbank Western System Burbank Channel Grant of Easement\nRecommendation: Acting as the Governing Body of the County Flood Control\nDistrict (District), acting as a responsible agency for the Burbank Water and\nPower Campus Stormwater Improvement Project over Burbank Western System\nBurbank Channel (Project), consider the Mitigated Negative Declaration (MND)\nprepared and adopted by the City of Burbank (City) (5) as the lead agency,\ntogether with comments received during the public review period; certify that the\nBoard has independently reviewed, considered, and reached its own conclusions\nregarding the environmental effects of the County's approvals related to the\nProject as shown in the MND; find that no mitigation measures in the Mitigation\nMonitoring and Reporting Program are applicable to the County's approvals of\nthe Project and no additional mitigation measures within the County's power are\nnecessary to lessen or avoid any significant effect of the Project; find that the\ngrant of easement for covered storm drain and appurtenant structures and\ningress and egress purposes within Parcels 82GE and 83GE related to Burbank\nWestern System Burbank Channel in the City, and the subsequent use of said\neasement will not interfere with the use of the affected parcels for any purposes\nof the District; approve the Project, which is the grant of easement for covered\nstorm drain and appurtenant structures and ingress and egress purposes within\nParcels 82GE and 83GE related to Burbank Western System Burbank Channel\nin the City, from the District to the City; and instruct the Chair to sign the\nEasement Deed document and authorize delivery to the City.
