PUBLIC HEARINGS:\n\n\nA. Quarterly Lien Action for Delinquent Sewer, Rubbish and 21-2080\nWeed Abatement Accounts\n1. Authorize staff to complete and record lien notices against real\nproperty for those sewer accounts sixty days or more delinquent as\ndescribed in Certified Lien List and direct staff to forward recorded\nliens to the County for collection.\n2. Authorize staff to complete and record liens against real property for\nthose rubbish accounts more than ninety days delinquent as described\nin the Certified Lien List and direct staff to forward recorded liens to\nthe County for collection.\n3. . Adopt Resolution No. 2023-025, of the City Council of the City of\nFontana adopting the statement of unpaid expenses for weed\nabatement and imposing a lien against real property for payment\nthereof.\n\n\nB. Continuance of Appeal No. 23-001: A request to overturn 21-2017\nthe Planning Commission’s decision on January 17, 2023,\napproving Master Case No. 20-083 for Tentative Parcel Map\nNo. 20464 (TPM No. 20-021), Variance No. 22-001,\nConditional Use Permit No. 20-025, Conditional Use Permit\nNo. 22-019, Conditional Use Permit No. 22-028, and Design\nReview No. 20-031 along with the adoption of an Initial\nStudy, Mitigated Negative Declaration, and Mitigation,\nMonitoring, and Reporting Program for the development of\ncommercial retail center to include a banquet hall, dual\nbranded hotel, restaurant/retail building, and a\ndrive-through restaurant (In-n-out) on an approximately 8.9\nadjusted gross acre site on the northwest corner of South\nHighland Avenue and Citrus Avenue (APNs: 0228-301-01\nthrough -08, 0228-310-20, -21, -22, -23, 0228-310-33 through\n-49, -51, and 52).\n1. Open the public hearing and accept public comments.\n2. Continue Appeal No. 23-001 to the April 25, 2023 City Council\nmeeting).\n\n\nC. 1st Cycle General Plan Amendment; Master Case Number 21-2010\n(MCN) 22-052: General Plan Amendment (GPA) No. 22-003,\nZoning Code (District Map) Amendment (ZCA) No. 22-004,\nZoning Code Amendment (ZCA) No. 22-012 and Design\nReview (DRP) No. 22-028 - A request to adopt the Mitigated\nNegative Declaration pursuant to Section 15070 of the\nCalifornia Environmental Quality Act (CEQA) and Section\n6.04 of the 2019 Local Guidelines for Implementing CEQA,\namend the general plan land use designation and zoning\ndesignation from Multi-Family Residential and Multi-Family\nHigh Density Residential to Multi-Family Medium/High\nDensity Residential and amend the required setback for\nbuildings on parcels zoned Multi-Family Medium/High\nDensity Residential (R-4) from parcels zoned Multi-Family\nResidential (R-3), in order to construct a multi-family\nresidential development comprised of 88 units and five\naccessory dwelling units, on-site amenities, parking,\nlandscaping and other on-site and off-site improvements\non a 3.64 acre site located on the west side of Sierra\nAvenue between Ramona Avenue and San Jacinto Avenue.\n1. Adopt Resolution No. 2023-026, a Resolution of the City Council of\nthe City of Fontana, adopting the Mitigated Negative Declaration\npursuant to Section 15070 of the California Environmental Quality Act\n(CEQA) and Section 6.04 of the 2019 Local Guidelines for\nImplementing CEQA, approving General Plan Amendment No. 22-003\namending the General Plan Land Use designation on approximately\n3.64 acres from Multi-Family Residential (R-MF) and Multi-Family High\nDensity Residential (R-MFH) to Multi-Family Medium/High Density\nResidential and approving Design Review No. 22-028 for the\nconstruction of a multi-family residential development comprised of 88\nunits and five accessory dwelling units, on-site amenities, parking,\nlandscaping and improvements; and\n2. Read by title only and waive further reading of and introduce\nOrdinance No. 1919, an Ordinance of the City of Fontana, approving\nan amendment to the Zoning Map changing the zoning designation for\nAPN 0241-071-41 from Multi-Family Residential (R-3) to Multi-Family\nMedium/High Density Residential (R-4) and changing the zoning\ndesignation for APN 0241-071-42 from Multi-Family High Density\nResidential (R-5) to Multi-Family Medium/High Density Residential (R-\n4), and that the reading of the title constitutes the first reading thereof;\nand\n3. Read by title only and waive further reading of and introduce\nOrdinance No. 1920, an Ordinance of the City Council of the City of\nFontana approving an amendment to Section 30-454 of the Fontana\nMunicipal Code (Zoning and Development Code) to change the\nminimum setback between buildings on a parcel zoned Multi-Family\nMedium/High Density Residential (R-4) and parcels zoned\nMulti-Family Residential (R-3), and that the read of the title constitutes\nthe first reading thereof.
