39. Willowbrook Senior Center Remodel Project Construction Contract\nRecommendation: Establish and approve the proposed Willowbrook Senior\nCenter Remodel Project, Capital Project No. 87914, (Project) (2), with a total\nproposed Project budget of $1,064,000; approve an appropriation adjustment to\ntransfer $1,022,000 derived from Utility User Tax, Cy Pres II, funds from the\nExtraordinary Maintenance Budget to the proposed Project; adopt the plans and\nspecifications that are on file with the Department of Public Works for\nconstruction of the proposed Project; advertise for bids to be received by\n11:00 a.m. on February 14, 2023; find that the proposed Project is exempt from\nthe California Environmental Quality Act; and authorize the Director of Public\nWorks to take the following actions: (Department of Public Works) ADOPT\nExecute a consultant services agreement with the apparent lowest\nresponsive and responsible bidder to prepare a baseline construction\nschedule for an amount not to exceed $5,000 funded by the proposed\nProject funds;\nDetermine that a bid is nonresponsive and to reject a bid on that basis,\naward the next lowest responsive and responsible bidder, waive\ninconsequential and nonmaterial deficiencies in bids submitted,\ndetermine, in accordance with the applicable contract and bid\ndocuments, whether the apparent lowest responsive and responsible\nbidder timely prepared a satisfactory baseline construction schedule and\nsatisfied all conditions for contract award;\nAward and execute a construction contract to the apparent lowest\nresponsive and responsible bidder if the low bid can be awarded within\nthe approved total budget, and establish the effective date of the contract\nupon receipt of acceptable performance and payment bonds, and\nevidence of required contractor insurance by the Department, and take\nall other actions necessary and appropriate to deliver the proposed\nProject.
