12.\n25-690\nApprove and Authorize Execution of the Third Amendment to the\nAffordable Housing Agreement and the Second Amendment to the\nDeclaration of Covenants, Conditions and Restrictions to Extend\nAffordability Covenants by Three Years for the Five Points Senior\nSeptember 2, 2025\nVillas Project (Revised Request) – continued from the August 19,\n2025, meeting\nRecommended Action:\nA) Approve the Third Amendment to the Affordable Housing Agreement by and between\nthe Huntington Beach Housing Authority and Five Points Seniors, L.P. to extend the\naffordability covenants by three years until July 30, 2029, and direct the City Attorney to\nrevise said Third Amendment to reflect this three-year extension;\nB) Approve the Second Amendment to the Declaration of Covenants, Conditions, and\nRestrictions by and between the Huntington Beach Housing Authority and Five Points\nSeniors, L.P. to extend the affordability covenants by three years until July 30, 2029, and\ndirect the City Attorney to revise said Second Amendment to reflect this three -year\nextension; and,\nC) Authorize the Housing Authority Executive Director or their designee to execute the\nThird Amendment to the Affordable Housing Agreement, the Second Amendment to the\nDeclaration of Covenants, Conditions and Restrictions, and all related documents\nnecessary to implement the three-year extension.
