C\n\nConsideration and possible action to find Ultimate Pool Remodeling, Inc., to\n\nbe a non-responsive bidder; and award a contract to California Waters\n\nDevelopment, Inc., dba California Waters for the Aquatic Center Outdoor\n\nPool Improvements, Specifications No. 23/24-06R; and authorize the\n\nCity Manager to execute a contract with California Waters Development, Inc.,\n\ndba California Waters, in a form approved by the City Attorney.\n\nCEQA: The City reviewed the environmental impacts of the proposed activity\n\npursuant to the California Environmental Quality Act (Public Resources Code\n\n§§ 21000, et seq. “CEQA”) and the regulations promulgated thereunder (14 Cal.\n\nCode of Regs. §§ 15000, et seq., the “CEQA Guidelines”). The activity\n\ncontemplates awarding a contract to repair and maintain existing improvements\n\nand therefore no further environmental review is required pursuant to CEQA\n\nGuidelines § 15301 (Existing Facilities). Additionally, the project was reviewed per\n\ngrant requirements pursuant to the U.S. Department of Housing and Urban\n\nDevelopment § 24 CFR 58.35(a), and it was determined that the project would not\n\nnegatively impact the surrounding environment and the project location would not\n\nhave an adverse environmental or health effect on end users. The project would\n\ncomply with NEPA and other related federal and State environmental laws and\n\ndoes not require any mitigation for compliance with any listed statutes or\n\nauthorities, nor requires any formal permit or license.\n\nRecommendation to City Council: 1) Award a contract to California Waters for the\n\nProject and authorize the City Manager to execute said contract in a form approved\n\nby the City Attorney; and 2) Amend the FY 2025-2026 Operating Budget to add\n\n$175,000 to Account No. 011-47220-9000 General Fund Aquatic Center\n\nImprovements Project; or 3) Alternatively, discuss and take other action related to\n\nthis item.
