(10) 21-0946-S1 PERSONNEL, AUDITS, AND HIRING COMMITTEE REPORT relative to proposed Amended and Restated Professional Services Agreements with Examity Inc. (Examity; Contract No. C-135772) and PSI Services, LLC (PSI Services; Contract No. C-133329) for as-needed remote test proctoring and related services in connection with the City’s Civil Service hiring process. Recommendations for Council action: APPROVE and AUTHORIZE the General Manager, Personnel Department, to execute Amended and Restated Agreements to provide as-needed remote test proctoring and related services for the administration of the City's Civil Service tests, subject to the approval of the City Attorney, as follows: First Amended and Restated Professional Services Agreement with Examity (Contract No. C-135772), to: Extend the term by one additional year resulting in a four-year term effective March 2, 2020 through March 1, 2024. Increase the expenditure authority from $500,000 to not to exceed $700,000. Update the City's standard contracting provisions to include the "Standard Provisions for City Contracts (Rev. 9/22) [v.1 ]". Second Amended and Restated Professional Services Agreement with PSI Services (Contract No. C-133329), to: Continue the five-year term effective December 1, 2018 through November 30, 2023. Increase the expenditure authority from $500,000 to not to exceed $600,000. Update the City's standard contracting provisions to include the "Standard Provisions for City Contracts (Rev. 9/22) [v.1]". INSTRUCT the Personnel Department to ensure Examity submits current documentation in compliance with contractual requirements including a current Certificate of Insurance that meets the requirements of the City's Risk Manager, prior to executing the Agreement. Fiscal Impact Statement: The CAO reports that services under the proposed agreements are only to be provided for as-needed and requested by the City. There is no minimum expenditure requirement. Funding of $300,000 is provided in the 2022-23 Budget within the Contractual Services account line item "Anytime Anywhere Testing program". The Personnel Department anticipates receiving additional funding from various City departments which may request services under the proposed Agreements. Financial Policies Statement: The CAO reports that as budgeted funds are available to support the proposed Agreements and expenditures in the current year, and future year expenditures are limited to the appropriation of funds, the recommendations of the February 17, 2023 CAO report comply with the City's Financial Policies.
