(28) 23-1012 CD 14 EXEMPTION FROM THE CALIFORNIA ENVIRONMENTAL QUALITY ACT (CEQA) PURSUANT TO ARTICLE 5, SECTION 15061(B)(3) OF CEQA GUIDELINES; and HOUSING AND HOMELESSNESS COMMITTEE REPORT relative to amended Covenant and Agreements for the Pueblo Del Sol development, Vesting Tentative Tract Map No. 53421, located at 1400 Gabriel Garcia Marquez Street in Council District 14. Recommendations for Council action: DETERMINE that the proposed amendments are exempt from CEQA pursuant to Article 5, Section 15061(b)(3) [The activity is covered by the common sense exemption that CEQA applies only to projects which have the potential for causing a significant effect on the environment, and where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA] of CEQA Guidelines. AUTHORIZE the Department of Recreation and Parks (RAP) to: Execute the amendment to previously recorded Covenant and Agreement No. 03-1591734, included as Attachment 1 of the RAP Board Report No. 23-165 dated September 7, 2023, attached to the Council file. Execute the amendment to previously recorded Covenant and Agreement No. 03-1591735, included as Attachment 3 of the RAP Board Report No. 23-165 dated September 7, 2023, attached to the Council file. Execute the amendment to previously recorded Covenant and Agreement No. 03-1291371, included as Attachment 5 of the RAP Board Report No. 23-165 dated September 7, 2023, attached to the Council file. Fiscal Impact Statement: The Board of Recreation and Park Commissioners reports that the recommended actions will have no impact on the RAP’s General Fund.
