(1) 09-0969-S4 PLANNING AND LAND USE MANAGEMENT COMMITTEE REPORT and ORDINANCE FIRST CONSIDERATION relative to amending Sections 19.00 through 19.12 of the Los Angeles Municipal Code (LAMC) to establish three new planning and land use fees and to align the adoption of fees with the Processes and Procedures Ordinance (Ordinance Nos 187712 and 187930). Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: DETERMINE, that the adoption of this ordinance does not constitute a project, as defined by the California Environmental Quality Act (CEQA) pursuant to CEQA Guidelines Section 15378(b)(4), which states that a project does not include "the creation of government funding mechanisms or other government fiscal activities which does not involve any commitment to any specific project which may result in a potentially significant physical impact on the environment." Furthermore, even if it were found to be a project under CEQA, the adoption of this ordinance is exempt from CEQA based upon CEQA Guidelines Section 15061(b)(3), which states that a project is exempt from CEQA if "the activity is covered by the general rule that CEQA applies only to projects which have the potential for causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA." PRESENT and ADOPT the accompanying ORDINANCE dated November 1, 2023, amending Sections 19.00 through 19.12 of the Los Angeles Municipal Code to establish three new planning and land use fees and to align the adoption of fees with the Processes and Procedures Ordinance (Ordinance Nos 187712 and 187930). NOTE and FILE the City Administrative Officer report dated September 13, 2023 inasmuch as it is submitted for informational purposes, and no further action is required. Fiscal Impact Statement: None submitted by the City Attorney. Neither the City Administrative nor the Officer Chief Legislative Analyst has completed a financial analysis of this report.
