(5) 24­0336 PUBLIC WORKS COMMITTEE REPORT relative to a proposed Personal Services Contract with Legacy By­Products, LLC, for recovery and processing services of dead animals. Recommendation for Council action: AUTHORIZE the Board of Public Works (BPW), or two members of the BPW, on behalf of the Bureau of Sanitation, to execute the proposed Personal Services Contract with Legacy By­Products, L.L.C., for the recovery and processing services of dead animals for a five­year term, with one five­year renewal option to be exercised at the City’s sole discretion, for a total potential term of ten years, which has been previously approved by the BPW. The total maximum not­to­exceed contract amount is $945,360 for the services and authority to execute is subject to the City Attorney approval as to form. Fiscal Impact Statement: The City Administrative Officer (CAO) reports that there is no additional impact to the General Fund. Funding is provided by the Solid Waste Resources Revenue Fund, which is not a full cost recovery fund. The Agreement includes Standard Provisions which Friday contain a City obligation - April 26, limitation 2024 - clause which limits the City’s PAGE 10obligation to make payments to funds which have been appropriated for this previously approved by the BPW.
