(19) 23­0459­S1 COMMUNICATION FROM THE LOS ANGELES DEPARTMENT OF BUILDING AND SAFETY (LADBS) relative to the authority to submit and accept Fiscal Year 2024­25 CalRecycle EA­35 Grant funds on behalf of the LADBS Local Enforcement Agency (LEA). Recommendations for Council action, SUBJECT TO THE APPROVAL OF THE MAYOR: 1. AUTHORIZE the submittal of grant applications to CalRecycle for the Fiscal Year 2024­25 LEA Grant Program. 2. AUTHORIZE the General Manager, LADBS, or designee, to: a. Accept the LEA Grant in the approximate amount of $60,911 (EA­35) from CalRecycle for the Grant Performance Period of July 1, 2024 through June 30, 2025. b. Execute, on behalf of the City, all EA­35 grant documents, including but not limited to, the grant application, grant award agreement with CalRecycle, request for payment, and to execute any other necessary documents relative to the grant award. c. E x p e n d s a i d f u n d s f r o m t h e a c c o u n t s l i s t e d i n Recommendation No. 4 below for the purposes set forth in the LADBS report dated April 23, 2024, attached to the Council file, and consistent with the grant requirements. Wednesday d. Negotiate, enter - May 1, 2024into, - execute, administer, expend PAGE 16funds, and otherwise manage Contract No. C­138983 with E. Tseng and agreement with CalRecycle, request for payment, and to execute any other necessary documents relative to the grant award. c. E x p e n d s a i d f u n d s f r o m t h e a c c o u n t s l i s t e d i n Recommendation No. 4 below for the purposes set forth in the LADBS report dated April 23, 2024, attached to the Council file, and consistent with the grant requirements. d. Negotiate, enter into, execute, administer, expend funds, and otherwise manage Contract No. C­138983 with E. Tseng and Associates, Incorporated (or a subsequent contract replacing Contract No. C­138983), consistent with the terms of the CalRecycle EA­35 LEA Grant, subject to the approval of the City Attorney as to form and legality. 3. AUTHORIZE the LADBS to prepare Controller instructions and/or make any technical adjustments that may be required, subject to the approval of the City Administrative Officer (CAO); and, request the Controller to implement these instructions. 4. REQUEST the Controller to: a. Accept and deposit EA­35 grant funds in the LEA Landfill Fund No. 527/08. b. Establish an appropriation account entitled, “Enforcement Assistance Grants”, account number to be determined, within Fund No. 527/08, for the receipt and disbursement of grant funds. c. Set up an account entitled “Grant Receivables – State” within Fund No. 48R for the 10 percent front­funding, to be repaid when grant funds are made available. Fiscal Impact Statement: None submitted by the LADBS. Neither the CAO nor the Chief Legislative Analyst has completed a financial analysis of this report.
