(3) 24­1066 BUDGET, FINANCE AND INNOVATION COMMITTEE REPORT and AUTHORIZING RESOLUTION relative to extension and substitution of the credit facilities for the Los Angeles Wastewater System Commercial Paper Program (LAWSCPP). Recommendations for Council action: 1.  ADOPT the accompanying AUTHORIZING RESOLUTION, included as Attachment A of the City Administrative Officer (CAO) report dated September 5, 2024, attached to Council file No. 24­1066, which authorizes and approves the negotiation and execution of certain legal documents in connection with the extension and substitution of letter of credit facilities that support the LAWSCPP and other documents and actions in connection therewith. 2.  AUTHORIZE the CAO to make technical corrections and adjustments as necessary to those transactions included in the CAO report dated September 5, 2024, attached to the Council file, to implement the Council’s intentions. Fiscal Impact Statement: The CAO reports that there is no impact to the General Fund from the approval of the proposed recommendations. The 2024­25 Adopted Budget includes sufficient appropriations within the Sewer Construction and Maintenance Fund for costs associated with supporting the LAWSCPP, including, but not limited to, Letter of Credit fees, interest costs, legal fees, remarketing agent fees, and other fees associated with this transaction. Annual budget appropriations for the LAWSCPP are subject to Mayor and Council approval. Financial Policies Statement: The CAO reports that the recommendations in the report comply with the City’s Financial Policies in that all fees and costs related to the LAWSCPP will be paid from the Sewer Construction and Maintenance Fund. - October 1, 2024 - pp p p 2024­25 Adopted Budget includes sufficient appropriations within the Sewer Construction and Maintenance Fund for costs associated with supporting the LAWSCPP, including, but not limited to, Letter of Credit fees, interest costs, legal fees, remarketing agent fees, and other fees associated with this transaction. Annual budget appropriations for the LAWSCPP are subject to Mayor and Council approval. Financial Policies Statement: The CAO reports that the recommendations in the report comply with the City’s Financial Policies in that all fees and costs related to the LAWSCPP will be paid from the Sewer Construction and Maintenance Fund. Debt Impact Statement: The CAO reports that there is no debt impact to the City’s General Fund from the approval of the proposed recommendations to extend and substitute the Letters of Credit for the LAWSCPP as the costs associated with such program are budgeted in the Sewer Construction and Maintenance Fund for Fiscal Year 2024­25.
